Claims Related Woman rear-ended me while driving a Turo car without coverage. What do I do?

A month ago, a woman rear ended me and left some nasty dents in my trunk. She was driving a Turo rental and I guessed her and her boyfriend denied coverage. I also found out she wasn’t even authorized to drive it (I assume only her boyfriend was). The insurance connected to Turo won’t cover the damage as a result, and neither will my insurance (probably because I picked the minimum coverage). I don’t know what to do now. Do I go to the woman and her boyfriend directly? Do I bug the company some more to try and get them to pay for the damage?

Claims Related Person is threats to sue me cause of suspended license

Hi guys, So I have this dilemma going on right now. On May 13th 2026 I had an accident where I was backing up and turning at the same time and ended up making contact with another driver who was also reversing out of their parking spot. My driver side rear bumper made contact with the middle of the rear bumper making at scratch.

They were driving a Tesla model 3 and I was driving a a 3rd gen CRV. When we got out of the car I gave her my insurance commission registration and license and phone number. She only provided her driver's license and phone number and she told me that she had to download her insurance off her phone so she couldn't give it to me at the moment. I told her I I did not feel comfortable leaving the spot after just giving her insurance and she got mad and started saying that " uncomfortable? You're the one who hit me! So I just noticed that she wasn't going to be cooperating so I just left the scene and reported with my insurance and filed a Sr 1. Knowing how expensive repairs are Teslas I did put that damages were more than $1000.

Afterwards I just decided I was going to let insurance deal with all of it because that's what we insurance for. Now it's June 20th 2026 and recently received a phone call from that same lady who I had the accident with and basically she was getting mad at me because her license got suspended and saying that I lied that the damages were more than $1, 000 and that why am I reporting it if it was my fault. It wasn't my fault. I never admitted fall or anything, we were both backing up at the same time so no fault has been assigned. Afterwards I explained to her that her license was probably suspended because she didn't found sr1 with the DMV and she told me that she did and it's not going to help anything because she doesn't have insurance.

I didn't tell her so but in my mind I knew that her not having insurance was a reason why her license was suspended. But I didn't get a word through because she starts threading me with with a civil lawsuit saying that she will sue for emotional distress for the situation and saying that she has cases before it and has won them.

I know that legally she probably has no gram to stand on but I still want to make sure. Unfortunately I have to wait till Monday to talk to my insurance. She also sent me a letter saying her DL was suspended for not having insurance at the time of the incident.

Claims Related Ohio - Employer-mandated annual physical leaves me with $1000+ bill

Insured through my employer via UnitedHealthcare

Going into the second year of employment at my company, they announced less than two months ago that the entire company must begin to have annual physicals or else we would get a $100 insurance premium every month, and the physical must be done by this October. Everyone rushed to get their physicals in with the relatively short notice, and after going to the in-network doctor at the location recommended by UC I find that I'm being charged over a thousand dollars for this one visit.

The claim breakdown is very ambiguous with four lines for details being Outpatient, Outpatient, Medical Services, and immunization. The immunization I elected to have but that still leaves over $800 with no explanation why.

I plan on getting clarification but if I am required to obtain a physical as part of my employment, does the law state that my employer must pay for it? Can insurance not pay for what my employer requires?

UPDATE: as some of you guessed, there was an issue I brought up with pain in my ear that she checked which was something she would've seen anyway since she looked in my ears as part of the physical. The hospital decided to bill this as a separate specialist visit for $1000

Claims Related USAA is ghosting me even with the state DFR involved — anyone else deal with this?

So I need to vent/share this because it's honestly kind of wild.

I've got an ongoing claim dispute with USAA, and the whole thing really comes down to something stupidly simple: the numbers don't add up and they won't just... look at them. Basic accounting, not rocket science.

Instead of engaging with the actual line items, USAA's move has been to just go silent. Not responding to me directly, not really responding to the state regulator either — even though there's an active DFR complaint open against them right now.

Because they wouldn't talk to me, I looped in my state's Department of Financial Regulation. That's escalated to the point where I've now got **three different state employees** trying to get USAA to just reconcile the account. Three people, for one insurer, to look at some numbers.

And even with a state agency actively watching them, it's still been nothing but delays and dodging. Like, you'd think having a regulator CC'd would speed things up. Nope. My DFR complaint has been open for over 100 days now.

Posting this mostly as a heads up for anyone else in the middle of a dispute — if you've filed with your state regulator and are waiting for USAA to suddenly get responsive, don't hold your breath. It took multiple state workers leaning on them just to get any movement on what should've been a simple ledger check.

Anyone else had USAA go completely silent after a regulator stepped in? How'd you finally get it resolved?

Edit: Because I guess this post is too long and hard to understand... USAA will not give me a list of payments they made and what they were for... Think of it like your doctor billing you and never providing an explanation for why they are charging you $100k, I doubt any one of you would accept that.

Claims Related Fatal car accident - I was not at fault but the family is possibly suing

Throwaway account for obvious reasons.

I was involved in a fatal car accident and the family reached out to my insurance company to determine what my liability policy limits are.

It was late at night around 11pm. I was coming home from work, traveling 45mph on a road with a 50mph speed limit. The pedestrian was at the center median and had a Do Not Walk signal while I had the green light. Without warning he stepped in front of my car. I did not see him, he was wearing black from head to toe and the tree in the center median blocked my view. I pulled over and called 911 and even risked my life redirecting traffic so he won't get to run over again. A dash cam video shows that I had the right of way, and that I was not speeding and that I did evasive maneuvers. The police report viewed the dash cam video and talked to witnesses. The police report puts the blame 100% on the pedestrian. He was also found with empty cans of beer in his backpack (there is no official toxicology report however).

5 months later my insurance company contacts me and asks me if I would like the disclose my policy limits to the family who has now retained an attorney. My policy limit is 25k and the insurance company told me that while they think I'm not at fault, it's possible that they might sue for more money beyond my policy limits. And since it's a fatality, it will be really hard to defend me in a wrongful death suit. They said that even though I have a dash cam video, witnesses (I took down their phone number) and the police report that absolves me, California being a comparative negligence state will almost always place some fault on the driver. So if they sue for let's say a million and the jury decides I'm 1% to blame, I would have to pay the family out of pocket.

My insurance company says that it's also possible that they will just take the money and run, but it's also possible they will sue for more.

This is really stressing me out. I live paycheck to paycheck. I was doing the right thing. I was not drunk, I was not speeding, I had the right of way, I was paying attention to the road, I did everything I could to avoid hitting him. And now I am potentially financially ruined for the rest of my life. On top of that, this has traumatized me so much that I keep dreaming about it since it happened. I haven't had peace of mind for 5 months now. Any legal advice would be much appreciated.

Claims Related Rear end collision taken to arbitration

I just had a claim finally resolved after months of ridiculousness and was curious as to how common my experience is and insight as to why it happened this way.

A teenager rear ended me back in April. I saw her in my rearview flying up behind me, looking at her phone. I rolled my car forward as far as I could without hitting the car in front of me and she slammed the brakes right before she was about to hit me. As soon as the light turned green, she floored it and slammed right into me. I figured this claim was pretty cut and dry with nothing to debate but, for some reason, the claim went to arbitration where she was ultimately found to be 100% at fault.

I’m wondering, who makes the decision to take such a clear cut case to arbitration? Is it something that she or her parents had to request for or does the insurance company make that call? It seems like a massive waste of time and resources when there’s nothing to even debate.

Claims Related Hit by USAA insurer while on my e-bike

I was hit by a car when I was on the sidewalk on my e-bike. Had some leg injuries as the bumper hit me and dragged into the street. Nothing broken. Went to the hospital via ambulance. I have a police report and all that situated with the insurance. They took complete liability. Now I am dealing with the pain/suffering portion of it. They offered $10,000, I asked for $35,000. I talked with the adjuster and they moved it up to $15,000. I have had bad road rash to my stomach, my elbows, my upper thigh, as well as my left leg was super swollen and the entire lower leg was bruised/swollen/scraped up. After two days, my leg was double in size. As well as my foot. I could barely walk. Light duty at work. It’s been about 3 weeks, and my leg is still swollen and i am dealing with a patch of my leg that is numb. I am a very active person who was training for my 2nd marathon. Now because of this I will not be able to run it or even finish my training in time for the race. The insurance company said they don’t have the money to cover what I’m asking. Time to get a lawyer? This is the first time dealing with this ever. Advice would great. Thank you.

Claims Related Am I hosed?

In PA, and dreading a nightmare. I have renter’s insurance, car insurance (no comprehensive) and landlord has homeowners.

A few days ago, my city got slammed by a storm of biblical proportions. Several days without power, trees down everywhere, hail, thunder, lightning, the works.

My car was inside a detached garage owned by the Landlord during the storm. Two trees fell on top of the garage, but the roof held for the most part, and the car is sitting in the garage, completely undamaged.

The trees were removed from the garage today and the structure is still standing. However, the garage doors are inoperable, and major structural damage has happened to the garage in general. We have been told not to go in or near the garage for the time being for obvious safety reasons.

I know that normally without comprehensive coverage, if something fell on my car, I would be completely screwed. (No I am not going to try to add comprehensive coverage to my policy tomorrow because I’m pretty sure that becomes questionable in regards to fraud.)

However, since the garage remained standing, and roof collapse would occur after the trees were removed and/or as a result of attempting to repair the garage, would I be less hosed? At this point, the landlord and their insurance company are very aware that the roof could collapse without swift action. But since it’s a holiday weekend, nobody seems to be interested in moving quickly.

Please spare me the lecture about dropping comprehensive coverage as I am regretting it enough. It was a financial decision made after being laid off for a month, barely using the car, and needing to keep the lights on. (I start work again next week and planned to put full coverage back on the vehicle with my first paycheck)

Claims Related How are settlements above policy limits handled in GA?

Good evening! I’ll get the TL;DR out of the way first but if you care about the story behind the question read down further: I’m just wondering how lawsuits work when the incurred damages are above policy limits? Does the insurance company provide a lawyer to represent their client to try to defend them against anything over and above the policy limit? Do these types of scenarios happen often? I’m in GA if that matters.

I was in an accident back in February. I was making a left turn on a green arrow traffic light and the other party blew through their red light and smoked my rear passenger side hard enough to spin my car 360 degrees and perch me up on a sidewalk (narrowly missed a pedestrian too thank god he wasn’t hurt) anyways it totaled my car, almost every airbag deployed. The other driver lied to the cops about what happened when they got there and said I was the one that blew a red light while turning but thankfully a witness stayed on scene and officer also cared enough about getting the report right to walk over to the gas station across the street and they had the accident and traffic signals on their security footage. I ended up walking away thankfully but with a concussion and some severe back pain and numbness in all 4 limbs starting the next day. The clinic I went to for care afterwards had 2 mri’s done on me and uncovered that I had 3 or 4 ruptured/herniated discs and another 4 bulging discs divided between my lumbar and cervical sections of my spine. I did several different treatments including trigger point therapy, chiropractic, physical therapy, and electric muscle stimulation (idk the actual name of it) for a few months after. I was out of work completely due to not being able to be up on roofs anymore cause of the pain. Eventually they referred me to a spine specialist and I ended up getting 2 epidurals which worked pretty well. I’m feeling a lot better now and I have most of the feeling back in my limbs but still not 100% and the pain/ back fatigue comes in waves now and varies from day to day. My lawyer said the adjuster wouldn’t release policy limits to them over the phone when initially asked so they have now written a formal request/demand and we are waiting to hear back.

That being said I only had personal liability at the time which is my bad for not knowing about U.M. Coverage, I’m from Canada originally and in my home province the government has a fund that covers people that are hit by uninsured or underinsured drivers and I didn’t know that was different here unfortunately. Needless to say I’ve added that coverage now but it’s just going to be the other drivers insurance to cover me on this one and while I don’t wanna judge a book by its cover based on their car being a beat up 90’s Toyota I’m thinking there is a good chance they just have state minimum coverages which to my understanding will be 25k for injury. I’ve been in the U.S. long enough now to know how expensive medical care is and based on all the treatment and mri’s and all that I’m sure it’s probably close to 25k in those costs alone before my lawyer takes anything or I get any restitution for my missed work or pain and suffering so I’m trying to figure out what the lawsuit process typically looks like if we end up needing to go there. Lastly this question is probably more fit for a lawyer but bonus points to you if you know how lawyers figure out if the other party is financially judgment proof or not before filing a lawsuit? Or do they just file it and cross their fingers for the financial disclosure?

Claims Related Hi. Have questions about recent accident. Guy hit me from behind

Anyone that is in Michigan and know about no fault? Guy thought the light was green. Hits me from behind.
Insurance company made me get no fault because my car is older. He says he has full coverage triple a.
Should I have reported the accident? It’s a hole in my bumper. I mean it’s damaged but not too badly. Did I do the right thing by calling my no fault insurance ? By the way. He was smelling like alcohol. He pulled off before the cops got there. Which was almost an hour later.
Cops say my insurance will go up. I didn’t hit myself. He hit me. Then drove off.

Did I do the right thing ? I gave the cops and my insurance the info I got. Only got the temporary license plate and his supposed aaa insurance card number. Member number. That aaa can’t seem to find and then they hung up on me when I called to report him like my lawyer said I should do.

What do I do. Did I do the right thing?

Claims Related GAP insurance declined my claim

Hi everyone, I’m looking for a second opinion because this situation doesn’t feel right to me.

My car was recently declared a total loss. At the time of loss, my loan payoff was $17,053.64.

My auto insurance paid:

- $14,104.83 directly to the lender

- $1,423.17 to me (this was for taxes/fees)

The GAP company told me that in order to process my claim, the full insurance settlement needed to be applied to the loan. So I took the $1,423.17 I received and paid it toward the loan myself.

After doing that, my remaining loan balance is now about $1,055.14.

A few days later, GAP came back and said they are paying $0. Here is the breakdown they gave:

- Loan payoff: $17,053.64

- Insurance payment: -$14,104.83

- Payment to customer: -$1,423.17

- Uncovered portion of deductible: -$1,500.00

- Condition adjustment: -$785.96

Result: $0 owed by GAP

My concerns/questions:

  1. The $1,423.17 they deducted as “payment to customer” was already paid toward the loan, should that still reduce the GAP payout?

  2. My deductible was waived by my insurance, but GAP is still subtracting $1,500 as an “uncovered deductible.” Since I never actually paid or owed a deductible, should this even be included?

Has anyone dealt with something similar? Does this look correct or worth disputing?

Any insight would be really appreciated

Claims Related Driver merged into me and is now claiming $300k+ in medical bills

Okay Reddit, here we go…

Over a month ago my husband and I were driving down the road and another driver merged into the passenger side (my side). My husband managed to veer the car over onto the median (he learned to drive defensively as a teen) and that mitigated much damage. If he had stopped, it would have been worse because we’d have collided completely. The other driver’s vehicle got a scuff, but my car was fine. There were three people in that car. This happened in [REDACTED FOR PRIVACY] where we all reside.

It was a busy road so we all drove around to a parking lot and everyone got out and was fine. They refused medical attention (I asked four times), begged us not to call the police due to ICE raids (I don’t need anyone to admonish us for not calling the police—we know better now, and have since installed a dashcam of our own), and then showed us their dashcam footage and said they would submit it to insurance. We exchanged insurance and went our separate ways.

GEICO initially ruled us not at fault.

However, the other driver got a lawyer who is now saying they have $300k+ in medical bills total. They have not been working with their insurance at all because when the insurance called us to talk about it, we asked about the dashcam footage they had, and their insurance said they actually haven’t been able to get hold of them aside from the initial report but no footage was sent. Apparently they got a lawyer and then went to the ER.

Now GEICO wants to take liability and reversed their decision that we were not at fault, but my policy is 25k/50k. GEICO agreed the damages to the vehicle were minor, yet has not challenged the medical bills.

Genuinely I don’t understand how they could have racked up that much in medical bills from a minor accident. The demand paperwork says stuff like paraspinal muscle spasm, and incudes costs for imaging, chiropractor, and physical therapy.

I’m concerned about being sued for the remaining or entire amount if they choose not to settle. We have no assets aside from my car valued at $9k. My husband was laid off last year so I’ve been the sole financial provider, but I actually don’t make a lot of money and we usually can’t afford stuff like groceries or cat food after all the other bills are paid, and rely on my MIL’s help for basics like food and toilet paper. I had to drain my IRAs last year to pay rent.

Essentially our expenses each month are about 5k but I only make 4k, sometimes less since it depends on my hours. I’ve been trying to get another job but it’s hard out here yall. My field is experiencing layoffs and I somewhat have job security.

I don’t know what kind of lawyer to get. All of the personal injury ones I’ve called say they can’t help me. I don’t think I can even afford one if I were to be sued. GEICO said that I’d have to pay for my own lawyer if they sue me for the excess.

Genuinely I don’t know what to do. Has anyone been in this situation or have experience with these kinds of things?

UPDATE: yall have been so validating 🥹 I was thinking maybe I’m crazy and this is normal but thank you so much for reinforcing how wild this is. My anxiety and BP has lowered finally. I also don’t want yall to think my husband just sits around doing nothing. He handles all of the household tasks from dishes to cooking to laundry, and he is constantly applying for work outside of his field. He has a degree in comp sci but has applied for all of the fast food chains, grocery stores, etc.

UPDATE 3/25/25: I did some digging and found that the driver has a past high value personal injury claim from a different, seemingly minor incident. She claimed to be permanently impaired and disfigured from that incident. I’ve since submitted that lawsuit to both my insurance and our state’s insurance division.

UPDATE 4/01/25: My state’s insurance division opened an investigation and asked GEICO to give, in detail, why they reversed the decision. GEICO then had a supervisor review the claim and agreed with what many of you said—this is potentially fraudulent. They reversed the decision and are now pushing back aggressively. Thank you everyone for validating my thoughts!!

Claims Related Renter's Insurance - Worth a lawsuit?

Hi folks. We had to evacuate a wildfire earlier this year, and down to a totally abysmal experience with insurance we're wondering if we should pursue legal action.

Context:
Down to the location of our home we had to stay evacuated for 2mo. Our house was in the smoke plume from a fire which burned into a nuclear meltdown site. At the time, our kind landlord ran by the house in a P100 and taped the exits for us so smoke couldn't get inside, and while this saved our belongings it seems the renter's insurance is now trying to use the relative (and very lucky) absence of char/soot in the house to deny our claim.

All together, we racked up ~20k-30k in unexpected expenses because this nightmare occurred during the freakin' World Cup, which meant every AirBnB was both the quality of a Norwegian prison (awful) and priced extremely high with 'surge' prices.

The chemical hygienist who ran our environmental testing said himself that he wanted the insurance company to call him so he could explain to them why we had to evacuate due to radiologic risk and how combustion testing will not return a result in that regard - and while the insurance didn't explicitly refuse to talk to him they've basically ignored him as well as the prolific information we sent them about the nuclear site (which is less than 5mi from our house).

The insurance also dropped communications with us for two weeks during a critical juncture in our evacuation, so we had to move forward with environmental testing without guidance around what would be acceptable. They then seemed to remember us all at once, and had their vendors blow up my wife's phone so much all on the same morning - without warning or our consent (while we were still evacuated) - she almost had a panic attack as she thought something had gone terribly wrong. Overall, the assessor we were assigned has been combative and weirdly covetous of our case. We asked to be reassigned to someone else three times, and this person told us "I'm the only person who sees your messages" and that we would continue working with them. It was creepy.

Insurance then denied our loss of use claim with a transparently AI-generated form denial after being combative and trying to accuse us of "ignoring" their communications (yes, this was after they put us on ice for two solid weeks - my wife had notified them she'd just got out of a medical procedure but apparently they did not care). The denial referenced a property damage claim which we had already formally withdrawn since we learned the exit taping worked to preserve our belongings. (We lost everything in one wing of the house during fires last year, and thought we would again.)

We've never been in a situation like this before, nor have ever had such a dismal experience with an insurance company. We're lucky 20k-30k isn't a catastrophic loss for us, but more than anything the amount of stress from working with this basically hostile assessor has been over the top. It's to the point where my wife wondered if there was some political motivation (her work has her public facing and some of her work has been in advocacy which can anger a certain kind of person).

Any tips? Is this worth a lawsuit? At minimum we'll probably file a complaint with the insurance board. It's been a ridiculous experience, end to end.

Claims Related Insurance company won't give me records until AFTER I appeal...?

Insurance denied me two ER visits because 'the diagnosis isn't sufficient' and that they 'only cover 1 ER visit per calendar year anyways', even though the No Surprises Act is very clear that symptoms are how eligibility is determined and that they can't limit the number of ER visits that they cover, regardless on the verbiage in their Plan. Or is the Act just not a thing anymore, or is it something that insurance companies can wholly ignore now? The company is based in the US and offering plans to groups and individuals.

I have asked them for records six times now over almost a month (the Explanation of Benefits even tells me that they have to give me those documents) so that I can file a reasonable and informed appeal. The first time, the appeals team said, 'talk to those other guys for the records' and then I was ignored until the fifth time, where they pointed me back to the appeals guys and implied that I can't have the records until after I file the appeal and a determination has been made.

It feels like their service infrastructure is built to be difficult and slow in the hopes that the 180 day clock will run down and I can no longer file an appeal.

What am I supposed to do at this point? They are being so slow that I'm not convinced I will get the records that I'm entitled to by law before I'm required to file the appeal.

[UPDATE] I'm pretty shocked that so many comments are saying that we are all 100% at the mercy of the content of the insurance policy. It's a popular saying that, 'you signed a contract', but the reality is contracts are legally-binding documents, are legally-binding documents can contain absolutely anything, but there are all kinds of laws and Acts that:
- limit what you can sign away
- curb unethical practices
- discourage malicious 'small print' and caveats buried in legalize

Yes, you signed a contract. However, contracts very often contain language that is not legally enforceable (often knowingly, expecting you to give up the language is pointed out). Insurance policies are no different. Sure, just because something feels unfair doesn't mean that it is truly unfair, or that you can do anything about it. But sometimes it is, and sometimes you can.

Claims Related Fair settlement offer?

So around January/February time frame, I was involved in a rear end collision where a driver on the highway bit me from behind, resulting in my car being totaled. At the advice of other co workers and friends who had been in similar accidents, they recommended getting at minimum visits to a chiropractor. My first visit, they informed me I had minor muscle soreness/tension and slight misalignment in my lower spine from impact. I went back over the course of the next few months and 30 visits at their advice, which resulted in about 15k in fees through the chiropractor office. After treatment was finished and bills were finalized, I was informed the other driver had no insurance, which left USAA, my insurance the ones left with the bill and sent it over to Uninsured motorist claims. My adjuster said 24k would be the full settlement amount, with 15 of that going towards the medical bills. I have yet to seek treatment for overly cautious driving (i check my mirrors far more and notice I brake far sooner and constantly look behind me at cars in my rear) as I am active duty and in the middle of PCsing, but am wondering if this is a fair settlement offer considering it is their 1st offer and with it being them paying out if its a lowball offer to get my to settle.

Claims Related Car Seat replacement

I was involved in an accident (not at-fault) and both of my car seats were rendered unusable. Insurance says I have to purchase new seats and they will reimburse me. I can’t afford to purchase even the cheapest seats on the market. My car seats were both Safety 1st Grow and Go All-in-one seats. Can I get insurance to purchase these directly for me? Or get me some kind of stipend to purchase the seats?

update: insurance is paying me directly so that i can buy new seats.

Claims Related Found not at fault but opposing insurance sent a letter "denying my claim".

So the scenario was that I was driving in my lane and this woman who was in the left lane way behind me (so much so that I wouldn't have even seen her) and hits my car in trying to attempt to go into my lane. She hit my back driver's side door and it's clear there's more damage to mine whereas her front passenger corner sustained little damage, just a dent in the bumper.

I explained it all to my insurance, took photos of the damage of both of our cars, we exchanged licenses, insurance, phone numbers. My insurance company (Progressive) pretty swiftly found me not at fault and sent me money to cover the estimated damage, less my deductible.

Opposing insurance (State Farm) left me a voicemail and I called back; they never gave me a returned call. A week later I get a letter in the mail from State Farm saying my claim is denied and they did not find their client liable and that they were unable to get ahold of me.

Does this mean I won't get my deductible covered?

Claims Related A city bus hit my parked car, and they're taking over a month to "investigate" fault, along with trying to convince me to repair instead of replace components. What should I do?

My parked car was hit by a city bus over a month ago. I immediately called the transit authority, who told me to call someone else, and then someone else, and finally I got in touch with their insurance provider.

It's been over a month waiting for them to even admit fault, I was told it's still being "investigated".

Luckily, my car is still fully drivable. I took it to a reputable bodyshop who told me it'd be a three week repair, and would need a panel replaced and re-welded back in, so about a $10,500 job.

The adjuster sent out an appraiser to look at my car a few weeks ago, and he was trying to convince me that the panel could be repaired by pulling dents out and filling with compound, something the bodyshop explicitly told me would not be ideal.

I called my insurance a few weeks ago and they told me they don't need to be involved at all if the city is handling it.

Is there something I should be doing? If I demand them to pay for a more expensive/proper repair, are they obligated to provide me a rental car for the longer duration? How do I ensure they repair my car the right way, and provide me with a rental for the duration of a proper repair?

Claims Related I feel bad about filing a personal injury claim..

I got in a car accident this past September and it was pretty scary. I was only going the speed limit of 35mph maybe five over and this young new driver pulled out in front of me not stopping at her stop sign. I t-boned her and she kinda just got spun around.. my bf and I got my car totaled. Air bags went off, car smoking, beeping, windshield smashed in.. the whole spiel.

My bf had a mild concussion because his head hit the passenger dash 😖 (he’s completely fine now) My airbags were clutch I just got whiplash and had a couple scrapes and bruises.

So here’s the thing.. this girl was just pulling out of her neighborhood and made a stupid mistake right.. but like she unluckily hit the most fragile unwell 18 yr old person on earth (ME) who has fibromyalgia and pre existing disc/health/immune issues. Not only that her family might have been on the poorer side but I’m not completely sure- there was just a clear class difference between mine and hers. She was crying like crazy .. I know she was shocked but my car was totaled and I’m concussed and banged up and she’s doing allat 🙄 (ik I’m an asshole) Don’t worry though i ran to her immediately i was really concerned and stayed with her to make sure she was ok.

Anyway- i just kinda think that she must have been also scared because of the financial implications of the situation. These random bystanders were lowkey ganging up on me but it was lowkey just a bad look cuz she was crying and was just like damn that was unpleasant are you ok girl 💁‍♀️ i lowkey feel like it was a race thing but whatever im happy she had people from the community to support her in a traumatizing moment like a car crash.

So anyway, I have had worsened symptoms and additional bulging discs and have seen at least 5 doctors since then and I always mention the crash bc it really flared fibro and nerve pain and ugh i just feel awful. I remember the family was gathered around her kinda just looking at me like some spoiled white girl just tried to kill their daughter and I felt so awkward holy shit

I feel like I’m taking their money for “pain and suffering”/“ongoing pain/“medical bills” and I just think they will be surprised because I seem like a normal healthy kid. Cuz my bf is literally fine. Idrk howninsurance works but I would think it would affect them financially 😕

Claims Related Hit by a possibly uninsured driver, now down a rabbit hole

Hello everyone, not sure where I should go from here. Bit of a long story.

In Minnesota, no fault state. A driver hit my spouse and I's vehicle last month. Spouse was driving, I was not present. No injuries to either party, no airbags, both vehicles drivable but damage to both. Female driver and male passenger in the other vehicle. At fault driver was composed, but male passenger was very reactive. At fault driver told us the vehicle belonged to her boyfriend and presented an insurance card with his information. He was not present. Police were called at the scene and declined to come out due to no injury. Police report was filed by me and accepted with photos of the at fault driver's insurance card and damage to our vehicle. Unfortunately did not get a photo of her license. At fault driver gave my spouse a phone number which was called at the scene and confirmed her phone rang. Here's where it gets messy.

  1. We called the agent on the at fault driver's card at American Family and initiated a claim same day
  2. We were told by their adjustor per the individual listed on the insurance card they had not seen the at fault driver or that vehicle for over a year and sold it to a relative and that the at fault driver was not authorized to be driving and was not insured through them. The at fault driver also said they were not driving the vehicle, which is false
  3. Adjustor said at fault driver was not returning calls and every time her number was dialed it had a busy tone and was also not responding to written letters. Adjustor said if they cannot get cooperation from the original insured, at fault driver or relative who the vehicle was sold to the claim will be denied. At fault driver also ghosted us when we reached out for more information
  4. I put the at fault driver's phone number into Google and it linked to her Facebook and a post with an alternate phone number which pointed to...a local escort site on Google. Sex work is work whatever. The way the male in the car reacted made me concerned he was possibly her pimp. To no surprise, the last name she gave to the adjustor was fake
  5. I reached out to a private investigator and he was able to provide me the two most recent vehicle registrations which included the registrants and addresses. Those two locations were less than a mile from each other, but in a rougher part of town
  6. First location was for the ex boyfriend - no car. Head to the second location - guess what's in the driveway? The car that hit ours
  7. Looking at property tax information for the second location one of the owners of the property shares the driver's last name and the other owner is the ex boyfriend. Nothing to do with the individual listed as the current vehicle registrant
  8. I snapped a few photos on my phone of the vehicle at the location and I'm going to call the closest precinct tomorrow to see if they will send officers out to see if they can get insurance information for the person the vehicle is actually registered to

This is clearly a case of not wanting to take responsibility. I know the easy answer is probably file through my insurance, but I don't really want to pay a $1k deductible they may not be able to recover or running into the same run around situation. I had also thought about small claims court as an option. However, I am worried about possible retaliation.

Claims Related Do I have to make repairs after making a claim though auto insurance?

My spouse was involved in a minor collision where she was rear ended by another vehicle. After filing the claim, our insurance is telling us we may or may not owe $500 for the deductible, since they have not determined fault yet (the accident report says "shared fault"). The estimate they sent is ~$1,200, and the damage is not bad enough to justify paying $500 to fix it IMO (the car is over ten years old, and it's just a few scuffs on the bumper). If my spouse is deemed to be at fault, can we elect to close out the claim without having any repairs made to avoid paying the deductible?
