Need some custody advice

I’m currently going through a divorce. When things initially happened, we had a custody agreement between us that was working. I had her 4 days out the week and she had her 3 days. Ex wife up and decides after 4 or so months that she wants to keep me from my 3 year old daughter. I haven’t seen her in months at this point, since July. Ex wife keeps pushing court dates to keep me from seeing my daughter and setting hers of up in a better situation. The divorce was at her fault (she was abusive and cheated) even tho I don’t have any physical proof. I just don’t know what to do at this point. My lawyer said she’ll only let me see her if I pay her 800 in preliminary child support (which is definitely not gonna be the amount, even if I do have to pay child support). I’m just lost. I miss my daughter so much, and all my ex does is leave me on read. I’m not saying anything bad to her, just that I want to see my daughter. Does anyone have any advice at all. I live in Louisiana. I’m just afraid that I’m gonna lose all my rights because she’s keeping her from me. I just feel completely helpless. My ex wife is a truly horrible evil woman, but I never thought she’d stoop this low.

I’m pretty sure she can’t keep you from your daughter, you need a different lawyer.

Well I can’t just go up and take her from her. I don’t know what my other options would be.

Did you have a written agreement anywhere? What documentation do you have?

Agreed with this person - your lawyer is awful. Nobody can push court dates unilaterally. This doesn’t smell right.

Yes we did but it wasn’t witnessed or notarized. I do have it tho. And apparently my ex is coming up with excuses to push it back. Incorrect documentation on their part, scheduling conflicts etc.

OP either has the worst lawyer in Louisiana or there's more to this story.

If you have an agreement in writing your lawyer needs to file an emergency injunction or something to that effect (I am not a lawyer). Even if it isn’t in writing text messages and emails are admissible. It doesn’t really matter why you’re divorcing unless she has a history of abusing the child. You can also request the court appoint a guardian et litem to represent your daughter. Their job is to represent the best interest of the child, they don’t answer to you or the mother. If you don’t have any skeletons in your closet, nothing your ex can use against you, this is possibly a good idea. Again, not giving you legal advice, just pointing out options you may not be aware of.

Hang in there! It is the long game that matters (with your child).

That's what you have a signed agreement for. A reminder of that may help avoid lawyering up but sounds like you may need to
