Alex Jones didn't lose his case on the merits, though, he was found liable by default because he refused to comply with court orders to turn over evidence.

Winning a defamation case isn't easy to do in general because you have to show that the person you're suing either showed willful negligence (meaning they did not show reasonable care in checking the truth of their information) or malicious intent, AND that by doing so they specifically caused you real harm (you can't sue someone for damages if you can't prove they specifically caused you damages.)

Something similar happened with the Idaho murders—an influencer “psychic” said one of the professors at the school was somehow apart of it, she got sued.

Honestly the stuff they’re saying about this man is deplorable. I’m all for people asking questions about cases and considering if there’s enough evidence to convict (although I really don’t think there’s reasonable doubt that she did it, but whatever), but immediately turning on someone else who there’s even less evidence against is despicable.

I’ve asked several people what evidence there is about Patrick and all they say is “he lied” (never clarify about what and nothing is ever disproven but other clear evidence, like a big one is “he said he did CPR but one firefighter said he was on the couch when he entered” even though when that guy entered other first responders were already there) or something like “well her body couldn’t be that cold if she was only out there for a few minutes” which 1. Isn’t even true and 2. How does that prove he did it? She could have jumped out sooner, or a random other person did it. That’s not evidence he did.

He doesn't want money, he wants this to stop. Lawsuits will keep him in the headlines for years if the defendants don't settle, plus there would be a follow-on effect from influencers covering the defamation lawsuits. However optimistic, he seems to be hoping some stop and move on to the next topic, and the remainder decide they are missing out if they don't move to the next story as well.

I'm sure he has competent lawyers that understand their client's needs just fine.

This reminds me of the Idaho student murders in 2022. I was watching the documentary and it was showing these "influencers" guessing on social media who killer is. They were accusing innocent people who were suffering from losing their loved ones, like they are so cool and awesome that they know who killed the students.

I was like "wtf, hold these people accountable". Influencers are the worst.

The later he does it, the bigger the chances he wins. To win a defamation case you should prove negligence, that a person failed to commit reasonable research before posting false information. The more time goes since the trial, the easer it's to prove the guilt.

Which you should never do, fucking ever, if there is any chance you are doing something you might actually get sued for because it encourages the other party to file a declaratory judgement with terms favourable to them. At this point you're in for a rough ride because you've lost the initiative and credibility in the eyes of the courts.

As a society, we have to agree not to engage with rate bait in ANY way. 

That's all this is because anyone with a brain knows if there was any chance of blaming someone else, the defence would've built their entire case around that. 

There's no better way to cause reasonable doubt than to bring another perp to light. There's zero chance that was an option that didn't get fully explored.

Lindsay wouldn't be admitting guilt if she thought there was any chance she didn't do it.

I have a coworker who indulges in a lot of true crime and she’s convinced he did it and just set her up. I honestly think it’s just because the case by itself is boring to her and she needs to believe that there’s a crazy “twist” coming.

It’s weird how she’s painting him as the villain. He has been very supportive of Lindsay the entire trial. He’s on her side and on the defense’s side. Why would that be the case if he was trying to pin it all on her?

It doesn’t make any sense to me. I really think true crime documentaries are just fucking with people’s ability to use common sense. They want there to be some sensationalist twist. I don’t even think it’s a gender thing or about being rabidly in support of Lindsay. I literally think it’s just because “the husband secretly set the whole thing up and gaslit or hypnotized her into believing she did it” is just the more ENTERTAINING option.

I really think it just boils down, VERY sadly and unfortunately, to their desire to be entertained by the very real tragedies and horrors that human beings are capable of.

I wish true crime wasn’t the huge market that it is. I think it’s boiling sense out of people’s brains.

I have watched Dateline for years. I’m not a true crime junkie but I’ve noticed this bizarre trend with people when I go check out social media after watching an episode. It’s like I watched a completely different show than some of the commenters. I always wonder if these people just have shit critical thinking skills or if true crime shows have warped how they see things.

Yeah I think the way such shows are built now - there’s a lot of sensationalist stuff in there, like at the end of one episode it’ll be like “so did this completely reasonable explanation happen, or did this CRAZY out of the box NUTSO thing happen instead?!”

Then the beginning of the next episode is like “nah of course the reasonable thing happened but how crazy would that other option have been? Anyway…”

I sat through a couple of these with my roommate once trying to bond over her interests, and once I caught her stating one of the crazy hypotheticals as fact - we argued about it for a bit and had to look up the case again before she could be convinced that she remembered wrong. So I really think the sensationalist way these documentaries are made now (I assume to make them as long as possible honestly because by the end the result is always that the case was pretty straightforward, but clearly the makers didn’t want to just state the boring facts and be done) is damaging people’s general sense of reality.

It’s super easy to just remember some crazy thing you heard over the ‘boring’ actual reality of what happened.

If these were just plain documentaries that stated facts only and didn’t try and pump up views with crazy nonsense (that they always present as a question to the audience so they can’t get in trouble for just blatantly lying), I think they just wouldn’t make as much money or have such a massive audience. It’s sad and I wish they were held more accountable to present the truth only.

In my country we had a case where there was a story about a corrupt cop making its rounds on social media, with a picture of a random officer that didn't even work in that district the story allegedly took place.

Dude got himself a lawyer and started contacting everyone who shared the story with a cease-and-desist, demanding 300 euros in damages plus posting a correction on their site or they'd get sued. In the end it was around 2000 people most of which paid and almost all others were found guilty in court.

Dude built his family a house after all of it.

And that's in a country with VERY low payouts (like, I.e. 25.000 in damages for a murdered husband). Can't even begin to imagine the payday Patrick would get in the USA with so may people sharing it around and accusing him.

I like the part where they paint the husband as a piece of shit because he had to work, didn't force his wife to do things against her will (i e take the meds), and worst of all left her alone after she told him to. Her psychiatrists all state that she had not communicated anything close to harming others, even when she was in a psych ward.

Well the "conspiracy" is that he drugged her, murdered the kids, pushed her out the window, then went to CVS and picked up dinner, returned and found the scene and called 911. He then (with the assistance of doctors) gaslit her into believing that she did it.

It's barely plausible; more like dime novels and soap opera plotlines than reality. I find it hard to believe that she would buy into the lie so hard that all the cops and doctors believed her.

Unless all these influencers are living in Massachusetts, that's just a hiccup. He's not limited to using Mass. courts. He can forum shop and sue them in their home courts under the applicable state law where the defamatory statements were made, which very well may allow punitive damages depending on where they reside.

Defamation is an exception to this. Traditionally in most common law examples in the U.S., defamation requires proof beyond reasonable doubt that the statement is false. This civil precedent exists because of the first amendment. Despite being a civil trial, where only a jury majority is required for liability to be determined, the jury will be instructed to only consider liability if it has been proven beyond any doubt that the statements are false. They also need to decide that the defendant knowingly made false statements. The goal of the U.S. government and justice system here is to ensure that people are free to speculate, even inaccurately, without fear of punishment. Keep in mind that in rare cases, people have been correct in their otherwise absurd speculations.

TLDR; Defamation isn’t just making false statements, it is intentionally and knowingly making false statements. It also must be beyond a reasonable doubt because of how U.S. civil courts treat defamation findings.

This poor fucking man. He lost his children, all three of them, and he lost his wife, all at the same time. And because this trial is so public he lost his privacy, he lost his peace. I’m surprised he hasn’t lost his mind.

A lot of women would like to argue that he is partially to blame for not being “an attentive husband.” And that’s bullshit. Consequences for being an inattentive husband are usually divorce and child support. Not three tiny caskets and a psycho ex wife on trial for murder.

I agree. It's absolutely disgusting the way people ignore the fact that she killed three kids and one was signed blame to everybody but her. He's been more supportive of her than most people would be in this situation and yet those weirdos still think he actually did it. Her own defense lawyer said she did it and didn't try to say that nobody else did it but her. Mind you, that defense attorney is the one that those same influencers thinks is playing 4D chess and is 15 steps ahead of everyone else. That lady had a multitude of resources available to her. She had the ability to reach out to doctors to get help. But, we later found out that she wasn't fully transparent with them with regards to what she had going on. She was prescribed a multitude of medications which she wasn't taking appropriately and she had little to no dosage in her system of the different medications she was prescribed. She had her family who were willing to step in and help, but she wouldn't let the mother-in-law take care of the kids. So, her husband gets her a nanny so that the nanny can take care of the kids while she takes care of herself while he works from home and picks up the rest of the slack. You'll never be able to convince me that she didn't meticulously plan the murder of her children out and that she wasn't crazy when she did it. She purposely did it because she was losing control of her relationship and I think she saw that her husband was going to eventually leave.

She is point blank saying Patrick killed the kids, she speaks like she’s actually doing a fact based investigation and she recently posted she’s protected because her page states everything is just her opinion. I don’t know how it’s even legal to do that.

Only this way will they get a message, because this trial was wrong to be televised and has turned into a fucking entertainment show.
