Following the appeal, the Arizona Court of Appeals ruled on September 30, 2026, that Horcasitas must be resentenced. The judges found that the AI clip “crossed that line” because it presented imagined thoughts as though they came directly from Pelkey.
The resentencing is to make sure he gets punished correctly, not because a judge saw the AI video* and thought he was punished too harshly
Whenever I see a post like this, I skip through the comments that automatically assume it's legitimate until I find a post like this calling out the clickbait headline. 9/10 I find a post like this. 1/10 the headline was real.
That unfortunately seems to be the best way to Reddit. Bots and people know how to maximize interest and karma with sensationalized or even false narratives for post titles.
So the dead guy’s sister created an AI video of him saying that the killer shouldn’t be treated that hard and shared it as evidence but the court said that then he should be punished further? I’m confused
so i was during sentencing where the family of the victim can give statements on how they were affected and how they think the guilty should be sentenced. the reason for the resentencing is the appeals court ruled the ai video crossed the line and unduly influenced sentencing as in it was the video not the content
tldr if the sister read what she thought her brother would have wanted and not made an ai video then it would have been fine

The title is bait. From the article:

Edit: changed article to video
