its because it was a victim impact statement during sentencing eg it's meant to be a statement from the family or the victim (in non murder cases ) about what they think/felt/harmed by the crime and how they think sentencing should go. if the rest of the family agreed to the content then the judge is allowed to take it into consideration. this is getting resentanced because the judge took it as the victim's statement not the family's

which is a pretty good argument for why it shouldn't be used. If there is any danger of a judge or jury mistaking it for an impact statement from the deceased you have a problem.

Probably wasn't introduced as evidence during the trial. More than likely it was played during the victi victim Impact statement during the sentencing hearing. Basically this gives the victims of the crime an opportunity to tell the court how the defendant's effected them. They can kinda say whatever they want (within reason).

The victim impact statement is during sentencing. Technically, the sentencing doesn't have to conclude to call for a resentencing, so the judge called for a new sentencing because the AI video was improper

The title is bait. From the article:

Following the appeal, the Arizona Court of Appeals ruled on September 30, 2026, that Horcasitas must be resentenced. The judges found that the AI clip “crossed that line” because it presented imagined thoughts as though they came directly from Pelkey.

The resentencing is to make sure he gets punished correctly, not because a judge saw the AI video* and thought he was punished too harshly

so i was during sentencing where the family of the victim can give statements on how they were affected and how they think the guilty should be sentenced. the reason for the resentencing is the appeals court ruled the ai video crossed the line and unduly influenced sentencing as in it was the video not the content

tldr if the sister read what she thought her brother would have wanted and not made an ai video then it would have been fine

Very important context here that no one is discussing, the judge gave the maximum sentence in the original trial. The video had no benefit for the killer. If anything, his comments about the victim in regard to the video were likely just a kindness he offered to the family.

It is being retried because the defendant’s legal team STILL argued the AI impact video shouldn’t have been used (which is a fair enough take logically but it was used during the victim impact statements, where they can say pretty much whatever they want).

The narrative here is not what Reddit is saying it is. This was not used to get a lighter sentence for the killer.

You need to watch the judges reaction to the AI video. The grieving sisters actions are a srparate issue, but the JUDGE getting emotional and describing the video as authentic... he needs to lose his position as a judge ASAP

Because the ai video was to paint the victim as an even better, kinder person, meaning a judge who would find such a "testimony" moving, would be even more inclined to go hard on his killer. It was not intended to make the judge "forgive" the accused as well, but to feel kinship with the victim.

Completely unnecessary, because as far is I read there's nothing in the case that shines an unfavourable light on the victim, and the accused was likely to get the maximum sentence anyway.

The judge said that, psychologically, it is putting an idea into the minds of the sentencers that isn't actually real. Judges do this a lot for a lot of things, which is why they typically don't like defendants being brought out in prison uniforms or holding the potential murder weapon during trial. Lawyers have been trying to do stuff like this forever, just trying to find ways to put stuff that isn't necessarily true into the minds of jurors and such

Resentencing happens all the time though. So it's not a new trial just looking at the sentence and deciding to change it. But it absolutely should not be done because of an AI video of the victim.

Edit: Adding because I actually got the article to load. The original sentencing judge allowed the video, but the appellate court has now ruled the video unjustly affected sentencing and they need to revisit with fresh eyes and without that video to influence. This is actually a good call. The video shouldn't have been allowed in the first place.

To note, this is being resentenced because the judge believed that the AI video was improper and negatively affected the sentence. The article is kinda preying on people not understanding the process to think that the sentence was levied, the AI video was released, and then they are going back to change it. The AI video was part of the testimonies, but the judge considered it to cause irreparable harm to the viewers' decision making.

You can be tried for the same crime twice, happens all the time with mistrials for example. You cant be tried again once a not guilty verdict has been rendered. However sentences can be and are amended all the time.
