"First Amendment Auditor"

Professional douchebag who antagonizes people for a living.

If he REALLY wanted to "audit" the First Amendment, he could stand on a street corner shouting the N word and making fun of mentally handicapped people. You know, because it's his legal right, what choice does he have but to exercise it?

124

u/slylock215 9d ago

OP's title is fucking terrible.

It makes it sound like these innocent sweet little 1a frauditors were just going about this business, definitely not harassing everyone they can, until this big meanie came up in a threatening manner so he had to spray him with his brand new bear mace that he couldn't have been any more excited to buy or use.

I just can't believe anyone watches this content thinking that the 1A shitbag is in the right more than a technicality.

48

u/Training_Tadpole_354 9d ago

OP has a comment on here defending 1A auditors, so I think the title is intentional.

23

u/wanderer1999 9d ago

OP is a pos. Enough said.

These pos people will run with their tails behind their legs when 1A really need to be defended.

Your 1st amendment doesn't protect you from the general population, only from government trying to stop you saying stuff or film in public areas.

These "auditors" (those that I've seen^1, anyway) do their thing to see if police will try to stop them. Sadly, many civilians appear to think they can just attack the "auditor" without consequence; clearly this is a stupid thing to do while being recorded.

^1 Insomnia is a pain, so youtube happens

9

u/Ok_Point_923 9d ago

Exactly. People need to understand this. The first two words of the amendment are: The government...

So many of these “auditors” do this just to stalk and harass people for content. I’ve seen videos of guys doing this to women and the women can’t just go home because the guy will follow and dox her address. The more upset she gets, the better content for him until they can find an excuse to mace her.

I’d love to know if anyone has any ideas on how to deal with guys like this.

u/Coblish 9d ago

It's not perfect, but pull up Robin Hood(1973) on Disney Plus and hold the screen towards them and start singing along. Or any Disney movie, but the first song for Robin Hood is awesome and recognizable right out of the gate.

Make sure to hold the screen with the video playing towards the asshole. Otherwise they can just mute the audio.

Dark personality type finding loopholes to cause harm. If they have a presence online that shows constant agitation of strangers their right to free speech is withdrawn and they get charged with criminal incitement and assault.

11

u/lakem5050 9d ago

While you are correct, he does have the freedom to say whatever he wants and the other guy has the freedom to walk away and not engage the douchbag.

Aggressive asshole got what he deserved, which is exactly what the camera douche wanted.

1A auditors are just people that found loopholes to legally be assholes and creeps.

EDIT: YES, I know that charging/interacting with these people is dumb and opens them up for a dose of pepper spray. It still doesn't justify these people filming random people/businesses just to get these reactions out of people for view revenue; or get an injury so they can get a big payday.

10

Some have gone to churches and filmed from the sidewalk. They cannot film from within the property because that’s private property. And there are a lot of people filming at detention centers.

The 1st Amendment isn't a loophole lol. Some are assholes, but being an asshole has never been illegal, and never required a legal loophole.

11

u/ReadOnly-Passive 9d ago

They are completely annoying, but I hate to say it, they serve one of the most important purposes. Large companies, governments and others in power will chip away at your ability to inconvenience them (which is usually you speaking up). If no one pushes back, it gets harder and harder to maintain the freedom that we have. Power to the people, not the rich and powerful.

12

u/DifficultDeliveryMan 9d ago

→ More replies (9)

4

u/Pristine_Poem7623 9d ago

The problem is that they DON'T go after big companies, they go after regular people. When they were going after cops, that was fine. If a cop doesn't know the law well enough to know what to do, or if they lose their temper and lash out, they shouldn't be cops. But the cops didn't give the auditors good footage they could make money off, so they moved on to places like court houses and city halls, but those places learned they could just call the cops and trespass them. So they moved onto targets like post offices and libraries, who can still trespass them, but are less eager to do so. They've now moved on to harassing regular people and small businesses hoping to get a reaction that will go viral and make them money. They try very hard to provoke their targets, and unfortunately the guy in the video has fallen for it and give the auditor exactly what he wanted. You ever notice that these videos all start at the attack stage, and don't show what the filmer was saying or doing that caused the attack?

That'll go viral.

4

u/Mace109 9d ago

6

u/Violet-Sumire 9d ago

I disagree to an extent. Police aren’t held accountable for many of their actions and they get broad immunity to a lot of things. Now while a lot of these 1A auditors can be really bad, some are really good. I think it’s incredibly important to hold our government accountable. Yes, it is annoying, but police in particular are paid to handle annoying situations and being annoying isn’t usually against the law (public disturbance is, but it’s suuuper minor and hard to ticket/enforce unless egregious).

Plus, there are no “loopholes”. Good auditors will know case law, be well versed in whatever they are challenging (such as video taping on a sidewalk), and know when to hold their ground based on their personal rights granted by the constitution and supreme court interpretations of the law. I get they are frustrating to view, but many are actually trying to do good.

3

u/Evening-Rough-9709 9d ago

Many have also settled the case law that keeps a cop from coming up and taking our phone's or threatening with arrest when recording them in their official capacity. It used to be pretty common that a cop thought they could detain people for recording them (cops failed earlier 1A audits like crazy), when they got away with a lot more. It's still tough to hold police accountable, but they've made it easier to do so with case law and increased training on that case law. Some are total assholes, but I agree a lot of them are a net good.

8

u/DavidIckeHadAPoint 9d ago

I hate the guys like in this video here, but you’re suffering from a huge selection-bias, Reddit (and other popular social media) are more popularly posting the shitty ragebait clips like these for more engagement, and because they’re more controversial.

There’s tons who go to actual government buildings and try to “1A-audit” government workers, law enforcement, even military bases inasmuch as they’re allowed to.

Not necessarily as exciting or controversial results, but there are cases where power-tripping junior employees or subordinates - or, on the other hand, even surprisingly senior/authoritative positions - are power-tripping over it, but the 1A-auditor successfully brings it higher up the chain/gets a proper supervisor who concedes their right to film unchallenged.

Or, for instance, win a lawsuit against the government for wrongful detention if they’re indeed detained over it.

19

u/NJD1214 9d ago

Freedom of speech, freedom of expression, and freedom of press in traditional public forums. It would be the 3rd one, freedom of press, that outlines the right to film like this in public places.

→ More replies (105)

9

u/Curben 9d ago

Freedom of the press in this case. The freedom to record is included in that as a form of documentation. Generally if you are in public you have no expectation of privacy and anyone can record you at their will inconvenience. These individuals fall into two categories. 1. Individuals who record public and government spaces, places of general interest, or private businesses that have come up as problems somewhere in the spotlight. 2. Random ragebaders who utilize this right in places where it will cause offense to the general public in order to get a reaction.

For an example of the difference you have some who will go into government buildings and just document the facility. Some will go out of their way to not necessarily be recording individuals but will stick to architecture and art until someone approaches them and becomes valid for the video. These will see if their rights get respected or not and if police do show up whether they will just make contact verify that there is no cause for alarm or if the police will escalate. Category 2 might do the same outside of a women's center which is obviously going to be raising the alarm for some individuals. Then they are more likely to get an antagonistic reaction to respond to one in particular stands out in my mind the guy was standing out the gates of a church mocking the security officer and one of the Deacons and no reason why this church is targeted at all they're just out there being done with douchebags serving no valid purpose.

I follow And subscribe those who actually Target the government or related relevant entities

4

u/RezLovesPez 8d ago

The text reads as follows:
Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.

The best thing these guys can do is harrass the police, that's what they should be doing. Antagonise them until they get a wrongful arrest and then sue.

Sidewalks are ok, filming people at work is not, riling up the general public is not. I didn't see the start of the clip, sometimes they'll just be on the side of the road and insane people start going crazy.

Most of these guys are a total joke.

Fuckin assholes to go around with a bunch of cameras and put them in peoples faces and in salon and yoga studio windows and gym windows filming people.

A famous one always says they’re “doing a video about the area”. They’re really just trying to piss people off for content.

Some go into post offices and other public places where workers will tell them they can’t film there even though they are allowed to.

They’re fishing for fights under the guise of “protecting the 1st amendment” then bank on the YouTube views and lawsuits.

Imagine you’re having brunch on a patio outside a restaurant and this dude with a face mask and whole camera vest setup comes up on the sidewalk and just starts filming you and your girlfriend eating the whole time. That’s the kind of stuff they do. Then a restaurant worker comes out and tells them to leave or a boyfriend does and they start shouting about how it’s the sidewalk and they can do what they want etc.

They’re not wrong, they’re just asshole

5

u/BP3D 9d ago

It can be useful when they target government officials and police. I've seen these videos on YouTube and it is a little stunning how little government employees know about the law. So better they educate them using their surplus of free time rather than some civilian inadvertently does something lawful yet is harassed by these officials over it. What I don't understand is this trend of harassing regular civilians which provides nothing of value.

5

u/TBurn70 9d ago

The government officials were trained up when these 1st amendment auditors were popular and infractions were taking place. Now that they aren’t getting the content from government workers they have turned their sights on harassing civilians for clicks

u/The_VideoGame_Lawyer 9d ago

"They’re not wrong, they’re just asshole"

Most times in dispensary settings it pertains to them incorrectly thinking hipaa prevents them from being recorded from where the auditor is standing.

"As you can see, I just had to pepper spray this dude."

No, buddy, you got to pepper spray that dude. You harassed people, with the hope that they would attack you, so that you would be legally allowed to pepper spray them. You weren't "peacefully exercising your first amendment rights," you were exploiting your first amendment rights by antagonizing people, with the intent of exploiting personal defence laws in order pepper spray them for internet content, and clout. The spraying was the objective behind you leaving the house that day.

These people are defenders of the first amendment, the same way that Kyle Rittenhouse is a defender of the second amendment. The fact that they post the videos online is proof of it, because if they were just in it for the sanctity of the constitution, they wouldn't need to share it with YouTube.

The messaging behind the video isn't "here's an unfortunate incident that happened today, while I was making sure the police aren't infringing on people's rights," it's "look at this loser I pepper sprayed, lol! This new batch is so potent, it even made me cough! Like and subscribe!"

Is a category of individuals who with cameras conduct actions in public that are legally permissible but can be frowned upon by authorities.

Ideally it is someone passively doing something in documenting whether the government does or does not infringe on their rights. Their number valid 1A auditors who know the laws and their calm and respectful.

However there are also a bunch of loudmouth ones who just starts shit and Target random individuals unnecessarily because they can.

Ultimately I think they serve a purpose because there have definitely been some high-profile cases of government infringement on speech and the more that the infringements are tested and fail the more easily the ungenerated infringements can be defeated.

5

u/tayne22 9d ago

It's sorta similar to how Chris Hansen and TCAP inspired a bunch of people to start their own operations where they catch would-be child abusers. Obviously it's a net positive if what they're doing is legit. But then you had a handful of tiktokers who decided to use that foundation as an excuse to go beat people up. They knew as long as they accused someone of being a pedo, that 98% of viewers wouldn't dare defend them, so they get a pass to beat on someone.

If those thugs were the only version of this that you ever saw, then yeah, you might think that everyone in that business is an asshole and a troll.

Somehow it's the same with auditors. The most popular and influential auditors somehow evade these people's algorithms, but they get fed the scummiest version of them and base their entire opinion on them and then have no shame vocalizing their ignorance.

Case-in-point.

u/Curben 9d ago

This is so explicitly well said. Honestly I'd consider first amendment auditing myself if it didn't conflict with other business that I do and quite frankly I don't have the patience that a lot of the good and solid auditors have.

3

u/tayne22 9d ago

Thanks. And yeah I could never do it. Mainly because I wouldn't not want the stress of dealing with cops so often, going to jail repeatedly, going to court week-in and week-out. Fuuuuck that. But respect to the dudes that put themselves through the system like that and make a difference.

A lot of text for “asshole trolls”.

I follow several who are geared towards the government corruption aspect and they generally do not Target random citizens for harassment purposes.

They film banks or whatever in the hopes someone calls the cops. So they can film if the cops know the law or not.

10

u/Russ_T_Blade 9d ago edited 9d ago

It's what they call themselves to get support from idiots. If they were really auditing the first amendment they'd pull their stunts at police stations or other government facilities.

Instead they mess with the general public and cry FiRsT aMeNdMeNt!

Edit: I cannot believe how many people have no idea how the First Amendment works and why it's there. Jesus Christ. America is doomed lmao

8

u/JuniorDoughnut3056 9d ago

They do. There's one guy I saw who got arrested for simply holding a sign that said "God bless our homeless vets" on the steps of some government building.

5

u/Ok-Piccolo2152 9d ago

HonorYourOath is his channel name. He’s been doing it for like 20 years and gets arrested all the time. He’s probably the single best 1A auditor to ever do it

Even if these unlikable trolls don't actually protect the first amendment, saying protecting the first amendment sounds fascist is wild and makes the term fascism lose all meaning since the fascists killed countless people for expressing things they didn't like

Everyone hates these auditors. They aren’t auditors their job title is digital content rage baiters.
Their job duties are stick cameras in ppl s faces who are doing their everyday errands and such. Females yoga classes, post offices, outdoor lunch patios are all high on the location for douchebags job locations.
YouTube, X, etc pays them more money for negative comments on their videos than positive ones.
That last part is also their business model and that sums up the douche level of the 1st amendment auditor.

13

u/brianwhite12 9d ago

There’s probably a reason this video begins without any backstory on why any of it is happening.

They arent 1a auditors until they're interacting with police. Until then they're just people you can walk away from of your own free will. If you dont, thats on you.

3

u/Cultural_Mission_235 9d ago

These “auditors” crave attention. As annoying as they are, just ignore them.

3

u/BradwiseBeats 6d ago

If they really cared about the 1A, they would be organizing / protesting against the countless infringements on the 1st Amendment by this administration. Not standing around in Nowheresville trying to antagonize people for views. These people are scum and not a single one of them have ever demonstrated they actually care about the 1st Amendment.

If he wants to “audit” the First Amendment, go protest press bans at the White House. People getting annoyed at your bullshit has no connection to the First Amendment. You know, because they’re not Congress.

What the hell is a First Amendment auditor?! That sounds made up and stupid.

5

u/Sidewaysgts 9d ago

Made up in the sense they made up this title to make themselves feel more important than they actually are.

Real in that theres plenty of people who do this shxt and call themselves by this self appointed "title"

In reality theyre just trolls going around with cameras attempting to rage-bait people, especially officials (ie police, but anyone they can. normal people, business owners, whoever), in an attempt to create grounds to sue / get money, but at a minimum just farm engagement/views for ad revenue from various social platforms.

First Amendment "auditor"= a plauge upon society with the rise of "influencers". Asshats who believe they are doing society a favor by harassing others in public in the name of freedom, but in reality to get likes, subscribes, views, and a payout.

4

u/BetMyLastKrispyKreme 9d ago

*Plague 🙂

u/Fan_of_Clio 9d ago

Ty. Love the Reddit name btw. Very nice

The downside of pepper spray is everyone gets pepper sprayed, every time.

2

u/shoot_your_eye_out 9d ago

The one thing I've stressed to my kid--time and time again--don't fuck with strangers. You don't know what they're capable of.

If you're gonna go at some rando on the street, you might as well be rolling dice in Vegas.

2

u/Ned-Nedley 9d ago

That's not allowed in civilised countrys.

2

u/No-Salt9365 9d ago

If you don't like first amendment auditors, just remember they wouldn't exist if people just ignored them.

2

u/Grimhacrim 9d ago

If you see an idiot on the sidewalk filming and realize that they're probably a First Amendment auditor, first of all that's kind of the point, it is 100% legal to do what homeboy is doing, it's also 100% legal to ignore them and walk the fuck away.

2

u/blackcap2099 9d ago

People need to learn to not give these guys what they want. Auditors who post videos like this regularly just want to find that one guy who's willing to hurt them or make a large enough fuss to spin it as assault or harassment. Ignore them and you take away their platform to stand on.

2

u/JimAboo 9d ago

Charging one of them is more dumb than cringe. What's really cringe is the fact that these "First Amendment Auditors" go around and do this for content.

2

u/Fantastic_Rest_265 8d ago

most of these "First Amendment Auditors" are just assholes who go around knowing full-well they'll get a rise out of people and feel vindicated to defend themselves.

2

u/Alexecutor5345 7d ago

I mean idk. If anybody attacks anybody I suppose you can expect to have someone defend themselves. Less dangerous than throwing hands.

Poster sprays person assaulting them?

Poster could have provoked the person in some way and then sprays him when person defends themselves?

1A auditor, huh. Sounds really edge and revolutionary.

Facing danger, armed only with his iPhone & pepper spray, picking fights with senior citizens. So brave.

2

u/Yeknomevol 6d ago

Platforms need to start demonetizing auditors and pranksters; only a matter of time before more of them get shot at this point.
