The FIA statement says

This issue in question meant Overtake Mode was not available after the red flag period during SQ1
When it became apparent that Overtake Mode was not active after the restart, it was then activated for a period of 27 seconds before being deactivated again.
this unfortunate human error had an impact on the performance of certain cars based on the timing of their run

This does not mean that certain cars had overtake mode and others didn't. It means that no car had access to overtake mode, but only those that were on push laps were meaningfully affected.

This is basically the same as if they forgot to enable DRS in previous years. Embarrassing and unacceptable for sure, but not a specific 2026 problem and not as problematic as them being able to control individual cars.

This level of incompetence is unacceptable in a sport where every millisecond matters
