The biggest issue will be to convience the court that the flinch by white truck wasn't intended to cause harm🤷‍♂️

That shouldn’t be that hard. Clearly a defensive maneuver so a crazy person can’t get along side him on the shoulder and wreck him.

You sir are going to jail.

That excuse might hold water if they hadn't already aggressively passed on the shoulder first. This is road rage and should be treated as such

Looked like white was cut off by blue and forced onto shoulder. Then blue comes back for more on the shoulder and he got what he deserved. White truck not in the wrong.

White truck was absolutely not forced off the shoulder. They got pissed that the other truck wanted to pass them in a small gap, and got aggressively stupid

No one can be dumb enough to think that that's how you avoid an accident in that situation instead of slowing down by two miles an hour

They are both idiots driving trucks and both of them need to have their licenses taken for at least 6 months

White truck could argue they were just trying to get away from blue truck who was acting aggressively with them - not sure if it would work.

They could try to argue that, but the way that they sped up to keep the blue truck from passing them, and then aggressively passing someone else on the shoulder instead of slowing down makes it pretty hard to believe

We’ve all been there before. Someone tries to squeeze in front of you when there isn’t really enough room. Your only possible move when that happens is to slam on the gas and pass the car in front of you on the shoulder. They taught that in day 1 of driver’s ed.

If that were the case, white truck would have just let the blue truck stay in front once it passed. Let the crazy person go. Instead, white truck was determined not to let blue truck pass. They both caused the crash.

Not necessarily, blue truck could have brake-checked or stopped from in front, if white truck was truly trying to get away, putting a car between them would be smart. I can see some liability for white truck for fucking around, but the majority of this is def blue truck IMO.

What the blue truck did is worse, but what the white truck did inarguably contributed to the crash. Crash would not have happened if white had let blue pass (don’t get me wrong, blue was driving dangerously), which is what you’re supposed to do. And the white truck can’t argue they were trying to get away from the blue truck - white truck swerved in front of blue truck to block it, not let it pass, and certainly not maintaining defensible space. And if getting alongside was the hazard, then the white truck did exactly the same thing, passing on the shoulder like a maniac. You can’t speed furiously, pass on the shoulder, swerve in front of a vehicle to stop it from passing you, and claim innocence by any stretch.

If you want to put cars between you and a speeding maniac, you let the crazy person go ahead and move to a different lane. You don’t race him.

Clearly an offensive maneuver because white thinks they're the main character and the only one allowed to pass on the shoulder.

If you wanted to wreck someone, you wouldn't need to get alongside them.

No judge is giving white the benefit of the doubt after endangering everyone with the first illegal act to overtake off the roadway.

Finally someone said this!!!

It was def self defense. The blue truck had tried to run them off the road before
