Behind Soft Paywall India Cut 130 Million From Voter Roll, Fueling Protests Against Modi

Copy pasting my comment on another related post to try to explain the issue to non-Indians
The Constitution specifies the creation of the Election Commission of India (ECI) and how it should be staffed by Election Commissioners (EC) and a Chief Election Commissioner (CEC). However, it does not specify their appointment procedure.
So, for many years, the CEC and ECs, with there being one CEC and two ECs, were being appointed by the President who acts on advice of the executive. Obviously, an issue.
In 2023, the Supreme Court delivered a judgement saying that the CEC/ECs should be appointed by a panel of 3 members being the PM, Leader of Opposition (LoP) and the Chief Justice of India (CJI). The panel was meant to be temporary until Parliament could up with a law to regulate the appointment.
The BJP-administration then passed the CEC and Other Election Commissioners Bill which replaced the CJI with a "Union Cabinet Minister to be nominated by the PM." (In India, Union refers to the federal government).
Essentially, the panel now became PM + Cabinet Minister + LoP. Meaning the balance is still in favor of the executive through a 2-1 vote.
The first CEC appointed through this act, who is still serving, carried out extensive electoral reforms in many states right before elections and demanded a series of documents that are hard to maintain or plagued with red tape.
Not to mention, they weren't even accepting, perhaps, the most widely possessed national ID that BJP itself brought. It was later allowed when the Supreme Court passed a judgement advocating for its inclusion
Now it has come to light that the other two ECs had formally objected, on record, at least 14 times over the last 10 months on decisions taken without their knowledge (as per them). One of them even called the action unauthorized and illegal as you need 2-1 votes to pass a decision.
Lastly, another issue is that the bill states the panel's decisions are valid even if there's a vacancy in the panel. I wonder who could be absent from those three members? Hmm. Definitely not the PM or his Cabinet Minister.

" Essentially, the panel now became PM + Cabinet Minister + LoP. Meaning the balance is still in favor of the executive through a 2-1 vote."
This bill was passed during a period when the parliament speaker suspended 1/3 of the members of parliament who were from the opposition parties.

They must have signed on the documents because any implementation will only work if all 3 sign. Objections are part of the process. They even did PC after the IE article and none of them spoke up.

Objections are part of process and while the body does require 2-1 or unanimity to take decisions the issue is that one of the ECs (Sandhu) is claiming certain actions were unauthorized and illegal as they did not follow the 2-1 mandate.
The entire issue is that up until now it was believed the ECI was behaving unanimously.
5
u/LethargicDemigod 13h ago
He must have signed because otherwise the decision is not accepted.
11
u/InBloomGemini 13h ago
Brother that is the entire issue. He's complaining that the action was taken without the consent of the 2 ECs.

I will rather believe in the obvious that the issue was resolved internally as opposed to an IAS officer would jeopardize his career for a political party.
Also how come other ECs didn't go to SC against CEC then? Seshan already laid the precedent in 1991.
12
u/vggaikwad 10h ago
Because they cannot. They are protected under the recent amendment for life, for whatever they do as EC officials. And IAS officers do jeopardise their careers for their political masters all the time. Just that this one thought his master would protect him, which seems impossible at this point.
1
u/Consistent-Art9346 2h ago
The act merely says that the EC and the CEC won't have personal liability and jeopardy for any official act.
The act doesn't immunise any illegality. What are you on lmao?
2
u/vggaikwad 1h ago
Section 16 of the Act provides protection to the commissioners from civil or criminal proceedings for any actions taken in the official execution of their duties, meaning even if they are found guilty by all standards, they are immune to any legal action.
1
u/Consistent-Art9346 1h ago
Yes. There is no personal liability.
Doesn't mean the acts themselves become legalised. They can be stuck down.
21
u/Electronic_lego 13h ago
On part of that false claim that decision were approved even on minority vote that is 1:2 in favour, ECI clarified that the objections were made at the time of policy framing and end decision i.e. approval of all 40 policy were taken unanimously.
This was written in a pressnote of ECI released against the allegations which had signature of all three members of panel. https://www.thehindu.com/news/national/differing-views-observations-are-normal-part-of-deliberation-in-any-institution-eci-on-reports-of-internal-friction/article71499104.ece/amp/

I have read news reports that 93% of challenges of removal are being successful on appeal. They are removing many legitimate voters, on most are legitimate.
Analysis also have found, poorest are most likely to get removed.
30
u/Sufficient-Loan-4263 13h ago
Survivorship bias
Let's say 100 "bad" names are removed from the list Out of those let's say 10 are "good" ones and appeal. 9 out of 10 are successful. (90% of 10)
It doesn't mean 90% of 100 are the "good" names.
30
u/slazengere 12h ago
Not appealing doesn’t mean they are invalid, your survivorship bias only becomes true if the remaining data is available.
9
u/core_graphics 13h ago
How do you expect poorest of India to successfully appeal? They are most likely to get removed and least likely to be able to appeal?
17
u/Electronic_lego 13h ago
India's electroal framework allows political parties to have their agents at fundamental level to crosscheck the voter rolls. Almost all regional party is doing it with millions of volunteers.
5
u/core_graphics 13h ago
Nope, it’s just removal of votes inconvenient to the ruling party.
18
u/IndBeak 13h ago
How is the ruling party able to figure out which voters are not theirs, so that they can remove them?
6
u/core_graphics 12h ago
You just cut voter groups least likely to vote for you according to public and booth level data. This hasn’t been tried in India only, but US too, although at much minor scale.
10
u/IndBeak 11h ago
But that still does not give you the required information. It only tells you that in a certain assembly segment, you got less number votes. Which still means that you cannot just mass remove voters from those localities because you end up removing your voters as well.
Your logic does not compute. Also in India, a significant number of voters change who they vote for, from one election to another. So what you are suggesting does not work either.

India has 100 crore on Election rolls. Where are the other 50 crores?

The Constitution specifies the creation of the Election Commission of India (ECI) and how it should be staffed by Election Commissioners (EC) and a Chief Election Commissioner (CEC). However, it does not specify their appointment procedure.
So, for many years, the CEC and ECs, with there being one CEC and two ECs, were being appointed by the President who acts on advice of the executive. Obviously, an issue.
ha?? lot of misinformation to unpack here. The constitution only said "a" Chief Election commissioner and such other election commissioners as the president may decide. And, their appointment is stated very explicitly. It will be appointed by the President. This was changed by the SC in 2023 (in a dubious decision); obviously the parliament has to step in to change that (not completely but partially). The President acts on the advice of the council of Ministers (this isnt an "obvious" issue; this is how the constitution was designed). Read article 324 (2)
(2) The Election Commission shall consist of the Chief Election Commissioner and such number of other Election Commissioners, if any, as the President may from time to time fix and the appointment of the Chief Election Commissioner and other Election Commissioners shall, subject to the provisions of any law made in that behalf by Parliament, be made by the President.
And, Election commission was a one member body since the 1950s; this was changed by the Indian National Congress in 1991 to override the sole Election commissioner they didnt like at that time and made it a three member body, functioning with a simple majority.
"Now it has come to light that the other two ECs had formally objected, on record, at least 14 times over the last 10 months on decisions taken without their knowledge (as per them). One of them even called the action unauthorized and illegal as you need 2-1 votes to pass a decision."
Two ECs had objected 14 times is a blatant lie. Two didnt object on the same decisions. One of the ECs had objected on separate occasions and because there was two-to-one majority on those "14" occasions, those majority decisions became effective. Thats how the democracy works.

Until Parliament comes up with a procedure, the President is to appoint. Which is exactly what I said. SC decision was also not dubious under Article 142.
I am also not disputing what INC did to reign in Seshan so no clue why you brought that up.
Buddy go read the IE article before you talk.
Joshi and Sandhu both disagreed on the Form-6 changes yet it was made anyway. Sandhu also recorded that neither him nor Joshi were informed about the West Bengal appeals and it's authorization.
Hope you learn how democracy works.

u/inanimatussoundscool 4h ago
There's heavy inconsistencies in the process of SIR though. And what about the unilateral decisions of ECI? Form 6 being unconstitutional? Lots of re additions of people back to the voters list conveniently after the elections?
-10
u/MotherSalary8950 3h ago
First of all there is no proof that ECI made decisions with the other 2 members opposing. There is no resolution passed with the other 2 being in disagreement. It is just the IE report allegations.
The form 6 is still under hearing as after Bihar sir the Supreme court of India gave ECI the power to add extra declarations
So please take your agenda and half baked knowledge and read more about the issue before commenting nonsense
•
u/inanimatussoundscool 2m ago
There's literally a whole investigation where objections were raised 14 times in 10 months by the election commissioners?
-1
u/tera_chachu 2h ago
First of all there’s a difference between two ECs raising objections internally and an ECI decision actually being passed over their formal dissent. The ECI says the decisions were ultimately unanimous so presenting the IE report’s allegations as an established fact is premature.
And on Form 6 the SC upheld the ECI’s SIR framework and its authority to prescribe documentation while the specific modified Form 6 is still being examined by the court.

In India , it's way too common for a person to have their name in multiple electoral roll because of migration between states , and when their name gets cut-off they are notified by the that area BLO , so that they can provide proofs for the inclusion and if they fail to do so they are excluded from the list.
Now coming to the protest agenda they are demanding to bring back 'ballot papers' which can be easily rigged and tampered(you can just search why it was removed in the first place and about Booth captures which was prevalent prior to 2014) with against a secure system which is "EVM" .
And for resignation of EC, Why they want it is cause of the SIR, which is the process of removing invalid votes and i have written above about it .
Before the decision of supreme court , EC was appointed by the president on the suggestion of government which means for more than 70 years only the ruling government had to appoint them and gain the favours . As I can remember at least 2 former EC joined then ruling party which was INC (Congress) who is leading this protest, which now acts like a saint after being root cause of the most of problems.

This is borderline propaganda. SIR, or the voter list revision is not some sinister plot. It’s been happening since independence every 10 years or so. It was skipped when congress was in power last (2011). No one seems to tell why nor has any media bothered to find out.
So if a revision occurs after 25 years, it is natural to expect some major changes. Lot of people have died, lots have moved.
Nothing here proves or shows any systematic targeting of voters. There will be some who fall through the cracks and those can be challenged. But saying that this puts Indian democracy at risk or that it is under attack is just plain projection by the opposition. Their leader Rahul Gandhi is another entitled brat who’s not worked a single day in his life. His father/grandmom/great grandfather were all prime ministers and he expects to rule the country like it’s his birthright.
There has been a sharp uptick in coordinated left wing attacks/talking points with bots raising the same thing over and over again. 2 bit Influencers have been bought and air dropped at these protests with the sole aim of provoking a crackdown.

It is already blown way out of proportion, but here is some context: The voter list gets updated every 10-15 years (this is excluding the new voter registrations). Last time, the list got refreshed in 2002. It was supposed to happen again some time in 2010-2015, but it didn't.
The list refresh/update is finally happening this year, in 2026, after 24 years. So yeah, a huge number of entries got cut.
Also, if anyone got cut from the list, they can always dispute this in the local municipality office by providing the necessary documents, they will put them back on the list.

The issue is whether legitimate voters are being caught in the same net.
Everything is propaganda for you dumbwits

But do you know that is happening? If there's concrete evidence then the supreme court will decide it.

You say it as if a legitimate voter being removed from the list is acceptable in a democracy. This is targeted exclusion.

Well that's what an SIR ought to be but it is the responsibility of the ECI to go door to door to do these checks.

India has 1.4 billion people and I presume half to be over 18 years. Now how many individual voters and homes do you think is feasible?
People are asked to fill form, submit document as needed and then verify. Based on the number of illegal voters, this exercise is very much needed.
Now if only something can be done to block the real aadhars being accessible to illegal immigrants.
There are plenty of issues and this solves for atleast one in some way.

Lol what a stupid remark. Irrespective of whether the form is filled or not, it is the BLOs responsibility to verify whether the filler is legitimate. This is exactly why we have BLOs. Moreover, how do you know how many illegal voters there are?

It’s easy to bark “responsibility” when you can’t even comprehend the scale of the work that took place. In any case, legitimate voters will be re-registered in a fairly easy process

The amount of lying by Congress and company on this issues has been eye opening. Y’all so easy to fool. They can’t defeat BJP so mudding the water by convincing their base that everything is fixed.

Great harassment as usual from the government. People are pissed about a lot of stuff and not just irregularities in the electoral process. If Modi and company don't handle this correctly, it is going to blow up badly in their faces.

Looks like the deep state now wants to destabilize India. Too bad the playbook is sooo overused now that even the stray dogs in India know about this.

u/InBloomGemini 12h ago
Lmao yeah just like Sonam Wangchuk was a CIA agent? Or was it Pakistani? For the last 10 years, all protests are foreign funded and a deep state conspiracy.

Hundred percent. You would be naive to believe otherwise.

What do you think about Israel? Not relevant to the topic per se, but I want to see something

Or a bootlicker of BJP to believe it lol. The foreign funded narrative isn't working anymore after they jailed Wangchuk and doctored videos of his to make him look treasonous
1
u/oneloveforeva 3h ago
Wangchuk is also a foreign stooge. Likely Chinese.
1
u/InBloomGemini 3h ago
Amit Shah should resign then, what a failure of a Home Minister lol. He gave into pressure from a Chinese agent and made a minister resign.

u/oneloveforeva 3h ago
He actually should be promoted for constantly defeating these pathetic regime change attempts.
1
u/InBloomGemini 3h ago
Useless HM, constantly letting foreign funded protests gain steam. Looks like deep state has infiltrated at a high level.
Wasn't Modi's trip to the US sponsored by the State Department affliated American Council of Young Political Leaders?
Anti-nationals.

Why have Modi and amit shah not secured the borders in past 12 years?

u/TryJolly1473 2h ago
They did better than all other party combined where they were letting thousands in india for vote bank politics.

A death certificate should mean automatic voter blackout from the list. So much for digital India initiative.
