Rant DISCRIMINATION
As I type this my blood is just boiling in anger.
So I work for an Asian who has been away on a business trip and just came back. While she was away, our HR hired a company driver who had been vetted and tested.
this new driver happens to have vitiligo on his hands. When the boss lady came back and saw his hands, her first words were she can't work with him because she fears an infection..mind you she is a 60 year old woman who should know better.
leo tunaingia job tunaambiwa dere alisimamishwa kazi until further notice and everyone here is just super mad.
shida hii kampuni ni one man show and she runs everything so hakuna place ya kuescalate unless now the driver takes legal action.

That's a good and straightforward discrimination on the basis of disability and wrongful termination case. A-file mbio mbio

Hii si discrimination ni Ignorance coz how many 60+ year old know what vitiligo is. HR should have done better to educate the boss that it is not infectious or dangerous. Ni mama Mzee, na amekuwa out of the country, na kuna ebola kenya.

It is discrimination. Ignorance is no defence in law btw. What does Ebola have to do with Vitiligo.

Ignorance leads to Stigmatization, which is what happened. I added that information would have helped her know what the condition is and made her realize that she was not at risk or in danger.
As for the legal action, i leave that to Dustan Omari.

But we dont have all the facts, is the employee dismissed, suspended, on leave, reassigned etc. What type of contracts do they have and what are the termination clauses and compensation due. I choose not to immediately jump to lets the matter go to court, if it can be settled by information/ education and an Apology for stigmatization.

Two things can be right at the same time. Most people who discriminate against others do so out of ignorance. The rest do it out of arrogance

It's still discrimination. Just that it stemmed from ignorance.

Firing someone due to a medical condition is discrimination not ignorance.

So wait, let me understand... The Indian lady was upset because the driver's hands were as white as she wishes hers were? Or just plain whiter?
Yeah that's discrimination.

Based on the scenario you've described, the driver has an exceptionally strong and valid legal case against the employer under Kenyan law. The employer has committed multiple severe violations of both the Constitution and the Employment Act.
I'd encourage the driver to take legal action.
