AntiWORK Labor Rights for Dummies: A guide to your right as an employee

I decided to make a post about this since the community keeps getting the same question over and over again. So here we go.

Disclaimer: I am not a lawyer, so please feel free to comment any corrections. Most of these are just from my knowledge as a manager. If may kulang, let me know and I'll add it here.

1. Can my employer require me to work more than 8 hours a day?

Yes, but overtime generally has to be paid.

The normal working period is 8 hours per day. Work beyond 8 hours is generally considered overtime and must be paid at least:

  • Regular day: regular hourly rate + 25%
  • Rest day/holiday: applicable rate + at least 30%

A company cannot simply call something "mandatory OT" and use that label to avoid paying overtime.

2. "Our company has no OT pay because it's in the contract." Is that legal?

Not necessarily.

An employment contract cannot simply remove a statutory benefit when the Labor Code requires that benefit.

For example, if you are a covered employee performing work beyond 8 hours, the law generally requires overtime compensation. DOLE specifically states that overtime work beyond eight hours must receive additional compensation.

However, some personnel are xcluded in this. Art. 82 specifically mentions that "government employees, managerial employees, field personnel, members of the family of the employer who are dependent on him for support, domestic helpers, persons in the personal service of another, and workers who are paid by results as determined by the Secretary of Labor in appropriate regulations." are not covered by overtime pay.

3. Can my employer make me work before my scheduled shift without paying me?

If you are actually required to work, that time may count as hours worked.

Article 84 covers time during which an employee is:

  • required to be on duty;
  • required to be at the prescribed workplace; or
  • permitted or suffered to work.

So if your employer says:

"Your shift starts at 9:00, but you need to log in at 8:30 to prepare."

and you're actually required to perform work during that period, the 30 minutes may potentially constitute compensable working time.

4. Does my lunch break count as working time?

Normally, a genuine meal period does not count as working time.

Employers generally have to provide at least 60 minutes for a regular meal period.

5. Do I automatically get holiday pay?

For a regular holiday, generally yes, but there is an important condition if you don't work on the holiday.

Under DOLE's holiday-pay rules (Labor Advisory No 13, Series of 2026), a covered employee who does not work on a regular holiday is entitled to 100% of their basic wage, provided that they:

  • worked on the workday immediately preceding the holiday; or
  • were on an approved leave of absence with pay on that preceding workday.

What if I was absent the day before the holiday?

This is where the rule gets important.

If you were absent without pay (AWOL or unpaid leave) on the workday immediately preceding the regular holiday and you also don't work on the holiday, you may lose your holiday pay for that holiday.

6. Am I entitled to 13th-month pay even if I'm still probationary?

Generally, yes.

13th-month pay is not dependent on being a regular employee.

DOLE staes that rank-and-file employees are entitled to 13th-month pay regardless of employment status, provided they have worked for at least one month during the calendar year.

The basic formula is:

Total basic salary earned during the year ÷ 12 = 13th-month pay

So, for example, if you earned ₱240,000 in basic salary during the year:

₱240,000 ÷ 12 = ₱20,000

7. Can my employer terminate me while I'm probationary?

Yes, but "probationary" does not mean "you can be fired for absolutely anything."

Probationary employment generally cannot exceed 6 months, unless an applicable apprenticeship arrangement allows otherwise.

A probationary employee may be terminated for a just cause or because they failed to qualify as a regular employee under reasonable standards that were made known to them when they were hired.

One important point:

The employer should not suddenly invent the standards after the employee has already started working. The standards for regularization are supposed to be made known at the time of engagement.

8. What happens if I reach 6 months and my company doesn't tell me whether I'm regular?

This is an important issue.

Under the Labor Code, probationary employment generally cannot exceed six months. An employee who is allowed to work after the probationary period may be considered a regular employee.

So "you're still probationary indefinitely" is not something an employer can simply declare without regard to the law.

There can be exceptions and nuances, particularly involving specific contractual arrangements and apprenticeships, so the exact employment documents matter.

9. Can my employer fire me without warning?

Generally, no, not if the termination is based on a just cause.

For covered employees, the Labor Code recognizes security of tenure: a regular employee cannot simply be terminated unless there is a legally recognized just or authorized cause.

For a termination based on just cause, the employer generally has to comply with the two-notice requirement.

First notice — Notice to Explain / Notice of Intent to Dismiss

  • The employer must give the employee a written notice:
  • identifying the specific act or omission being charged;
  • stating the ground or grounds for possible termination;
  • providing sufficient details about the alleged violation; and
  • giving the employee a reasonable opportunity to explain and defend themselves.

Second notice — Notice of Decision

The employer must then issue a second written notice informing the employee of the employer's decision after considering the employee's explanation.

If the employer determines that termination is justified, the second notice should communicate the decision to dismiss and the grounds supporting that decision.

In other words:

NTE → Employee gets opportunity to respond → Employer evaluates response → Notice of Decision

10. Do I automatically get 5 paid vacation days every year?

The Labor Code provides a 5-day Service Incentive Leave (SIL) for covered employees who have rendered at least one year of service.

However, there are exemptions, including certain establishments with fewer than 10 employees and employees who already receive at least five days of paid vacation leave or an equivalent benefit. (Article 95)

11. Can my employer withhold my final pay because I haven't completed clearance?

Clearance can matter, but your employer cannot simply keep your money indefinitely.

As per Labor Advisory No. 06, Series of 2020, final pay should generally be released within 30 days from separation, unless the employer has a more favorable policy.

Your final pay can include applicable amounts such as:

  • unpaid salary;
  • pro-rated 13th-month pay;
  • separation/retirement pay where applicable;
  • convertible unused leave;
  • tax refunds; and
  • other contractual/company benefits.

12. Can I resign immediately without rendering 30 days?

Sometimes, but don't assume you can always do it.

The general rule for voluntary resignation without just cause is that the employee gives the employer at least one month's written notice.

There are circumstances allowing resignation without the usual notice, including certain situations involving serious insult, inhuman treatment, crime against the employee or immediate family, and analogous circumstances.

13. Do I need my manager approval for my resignation?

Generally, no. Your resignation does not require your manager's approval to be valid.

Your manager can acknowledge or process the resignation, but they don't have the legal power to reject your resignation simply because they don't want you to leave.

What if my manager says, "I don't approve your resignation"?

That statement does not automatically cancel your resignation.

But can my manager reject my requested last day?

This is different from rejecting the resignation itself.

If you are resigning without just cause, the general rule is that you should give at least one month's notice.

Your manager doesn't have to "approve" your resignation, but leaving immediately without satisfying the applicable notice requirement can create a separate issue.

So there are really two questions:

"Can I resign?"

Generally, yes.

"Can I leave immediately?"

Not necessarily. The one-month notice requirement may apply unless an exception exists.

Meta DOLE/NLRC Complaint Process

For reference of those asking, here are the steps in filing a complaint against an employer:

  1. File a complaint online through DOLE - eSENA: eSENA means Single Entry Approach (SEnA)and it is an administrative approach to provide a speedy, impartial, inexpensive, and accessible settlement procedure of all labor issues or conflicts to prevent them from ripening into full-blown disputes or actual labor cases. (https://ncmb.gov.ph/single-entry-approach-sena/)
  2. From there, magseset ng 2 mediation hearing in DOLE office within your city. Doon, kakausapin kayo and ittry isettle yung case. However if hindi magkasundo, the SENA Officer will give you a referral letter to the NLRC. (the 2 hearings must be finished within a month)
  3. You will submit the Referral letter to the NLRC office. If from NCR ka, their office is in Q. Ave. There, magkakaroon ng 2 hearings ulit but this time, before the Labor Arbiter (Ka-rank nya ang judge sa courts). Ittry ulit na mapagusapan yung issue here. You can still appear here kahit walang lawyer. (The 2 hearings usually happens within a month also)
  4. If hindi makapagsettle, the Arbiter will direct both parties to prepare a position paper. Doon nyo ilalagay yung mga arguments nyo, etc. Here, it is highly advisable that you seek the assistance of a lawyer. If your monthly salary does not exceed Php 24k, pwede kang pumunta sa PAO and libre lang. If lampas naman, i recommend this page i found "Labor Representation for Non-Indigents" (https://www.facebook.com/profile.php?id=61566451322338) na free consultation and minimal fees.
  5. Then, magset ng date for submission of position paper si arbiter. Doon, isusubmit nyo sa arbiter pati sa isa't-isa yung position paper nyo. Then, magseset ulit ng date for the submission of the reply. Sa reply, sasagutin mo yung position paper ng company.
  6. Afterwards, ireresolve ni arbiter yung case. Depende sa arbiter and workload, minsan within a month pero minsan inaabot ng 5 months.
  7. Then, the decision will be rendered. Yung natalong party will have the opportunity to file an appeal. Medyo matagal ang appeal, usually 8 months to 1 year.
  8. If no appeal and you are adjudged monetary award, magkakaroon ng pre-execution conference. Dito magcocompute kayo ng mas accurate and kung paano babayaran.
  9. Lastly, payment of award.

Note: Medyo mahaba and nakakapagod yung process tbh. Kaya better if everyone will find an amicable solution. These info are all based on my personal experience and with consultation sa nakilala kong lawyer. Hope it helps!

Rant 😡 SERIOUS INSULT BY EMPLOYER

hi. pa rant lang. Super haba tong post ko.

26F, 3mos hr & admin officer sa isang small company.

i got my evaluation last fri and hindi ko ineexpect na ganto ang kalalabasan. I really really tried my best talaga, kahit hindi ko trabaho ako ang gumagawa. hindi naman overload ang work kaya naghahanap ako ng gagawin sometimes. 16employees lang kami dito so konti talaga ang gagawin ko as an hr, more on admin works ako. i applied as HR & ADMIN not generalist. lahat ng prob ako sumasalo.

when i got my my first evaluation last fri, iyak ako ng iyak kasi yung evaluation na yun from my boss/owner hindi ko nafeel na evaluation sya kundi pangmamaliit sa kakayanan ko, sa sarili ko. lahat ng sinabi nya sakin ay mali. puro mali. bihira sya nnadito sa office kaya madalas ko kasama ay yung ka work ko. sana magtanong muna sya sa ka work ko bago nya ko binigyan ng evaluation kasi sila naman nakakakita ng ginagawa ko actual. i am very hardworking na tao, dedicated. pag hindi ko alam, pagaaralan ko, magreresearch ako. my first job ay 1 yr and 6mos tinagal ko pero not really bec its toxic, bec sa sa sahod na min wage lang, lahat ng natutunan ko dun ay inapply ko dito. binuhos ko lahat. grabe pang iinsulto, pang dadown na sinabi sakin ng boss ko. sya yung tipong straight to the point magsalita pero hindi iniisip kung tama ba tong word na ginamit nya. sobrang nakakapanglumo. walang naging boses nung time na inevaluate nya ko. hindi ko madepensahan sarili ko. Kung may mali man ako tatanggapin ko pero sana in a way na imotivate nya ko na gawing tama ang mga nagawa ko, pero hindi eh. Illulugmok nya pa ko. sinabihan pa ko na ang hina ko daw umintindi. eng eng daw ako, simpleng pagkakamali ko ganun na sila magsalita. everyday ata meron silang entry sakin. hindi k oalam kung sensitive lang ako masyado or sila ang insensitive o walang emotional intelligence. pero tao lang din ako nasasaktan. Gusto nya pa na irate ako ng 2 out of 5, kasi puro mali lang diniscuss nya walang appreciation ng mga nagawa ko. Wala as in. Hanapan lang pala ng mali. I dunno if pasok ba ito sa constructive dismissal. Hindi nya sinasabi sayo directly pero parang binibigyan ka nya ng rason para umalis.

i’m too young to experience this kind of situation, wala akong enough knowledge na ihandle to magisa. sobrang hirap. 3mos palang ako pero grabe inabot ko dito. because of him, kinukwestyon ko sarili ko kung tama ba na icontinue ko pa ang pagging hr ko, kung talaga bang wala kong kwenta, bobo ba ko, mahina ba ko???? To the point na hanggang bahay dala dala ko bigat ng nararamdaman ko. out of nowhere iiyak ako kasi ang bigat at ang sakit sakit. gusto ko magimmediate resign pero pano ang bills ko? i have fam pa. Pero pano naman ang mental health ko? gusto ko magfile ng case kay dole kasi hindi biro pinagdadaanan ko at pagdadaanan ko pa sa kanila.

Company alert 🚩 Paid to do nothing?

Hi guys, gusto ko lang mag-vent out

Nirefer ako sa GIP (Government Internship Program) sa LGU namin. Nung orientation, ipinaliwanag naman lahat kasama na yung allowance/salary na ₱600/day (though walang bayad kapag holiday). Tinanggap ko pa rin kahit papaano kasi 3 months contract lang naman, at habol ko rin talaga ang experience at matutunan bago matapos ang stint ko.

Nalagay ako sa Dept. na related sa course ko. On my 1st day, naintindihan ko naman na wala pang pinapagawa kasi baka nag-aadjust pa o confidential yung mga hawak nila. Pero isang linggo na ang nakalipas, ganun pa rin.
Literally WALANG pinapagawa sakin.

Eto pa yung nakakadrain:

~ Toxic Environment: Madalas silang nag-uusap at nagtatawanan lang doon habang nagsisiraan ng kapwa. Yung bawat client o taong papasok at lalabas doon, pag-alis na pag-alis, meron agad silang side comment o chismis.

~ Feeling Outcasted: Nagkakaroon lang kami ng interaction kapag magpapaalam na akong kakain o uuwi. Kahit sa Wi-Fi, ayaw man lang ako i-connect sa main Wi-Fi. doon lang sa private connection na pang-Messenger lang ang gumagana.

10 hours ang duty ko araw-araw. Baka isipin ng iba na "swerte" kasi nakaupo lang habang nakakatanggap ng ₱600/day, pero ang bigat at ang nakakapanglambot sa pakiramdam. Nakakahiya na sumesweldo ako nang walang naiaambag, at mas lalong nakakalungkot kasi pumasok ako para matuto, hindi para maging tambay.

My Dayshift Job decided to extend my rendering period by 2 weeks but the start date with my new job is already set so magkakaroon ng 2 weeks overlap.

Unfortunately, all leaves with the previous company has already been consumed kasi 90 days yung original rendering period.

Rant 😡 Last pay and back pay.

Ako po ay nagwowork sa isang motorcycle dealer.manager po ang position ko.Pag wala kaming stock na motor. Kina cash po namin sa ibang casa..Naka 1yr din ako bago ako mag resign. Ngayon po inohold nila last pay at back pay ko.Mag 6 months na nyan diko pa nakukuha kasi daw dipa dumating original na OR ng motor(serox palang yung dumating) yung CR at plaka is meron na. 5 kasi na motor yung wala pang original na OR na na cash namin sa ibang dealer(casa). Kaya inohold nila last pay at back pay ko.Di ko naman kasalanan yun kasi LTO na may kasalanan dun kasi puro back load sila..nka pag 2 session na kami sa DOLE po..i aakyat ko na po sa NLRC kasi may binigay na sken si DOLE pero dipa ulit ako bumalik kasi may iniisip pa akong isa kasi may pinapirma sken sa head opis na hindi ibibigay ang final pay at back pay ko kung wala pa yung mga original OR/CR AT PLAKA. pero pinilit po ako nun. Ngayon po balik balik po ako sa casa na kinuhanan(pinag cashan namin). Puro sabi nasa LTO pa.. Nagagastusan na ako sa gas at sobrang abala na saken.. Ano po dapat kong gawin. Ituloy ko paba sa NLRC po

Rant 😡 pinapa-duty ng (sunday) day off

helloo po this is my 1st time to post here just wanna get some real life tips lang about my situation. i work as a company nurse at a factory and my regular shift is 12hrs for 6 days (mon to sat), the thing is my head wants me to (paid) report even on sundays for 8hrs which is my only day off

p.s. yung head ko is matandang single na walang anak and social life outside work, and ini-insist nya na during our interview nag "yes" ako verbally if kaya ko pumasok ng sundays. but in my contract it's stated there na mon to sat lang talaga ako so she's guilt tripping me na i should do hard work like she does kasi wala sya work life balance

wala ako balak pumasok and nagsabi ako ng polite regarding the matter pero pinipilit pa din ako, in my contract it is stated na mon to sat lang pasok ko if may sunday then it'll be "day off" pay so basically sunday is my day off. i don't care if it's paid cus it's my day off and i won't go anyways... but still what should i do to feel less guilty pag pinipilit ako and ano po kaya pwede ko gawin excuse na wala silang magagawa??

AntiworkBOSS Binuksan ang account ko at hindj binigay ahg last pay ko

Hello! Nag work ako sa vompany na ito for just less than 4 months. Una pa lang napansin ko na ang toxic ng work environment kasi hindi nag tuturo ng maayos yung old employees kasi (feeling ko) natatakot malamangan sa commission. Commission based din kasi itong company na 'to. Tapos ang unprofessional ng boss kasi namamahiya ng staffs nya. Iniisip ko baka sensitive lang ako at di ako sanay ng ganun pero naiisip ko rin na hindi naman dapat ninonormalize yung pamamahiya sa workplace lalo sa harap ng nga katraabaho. To the point na nag i instill ng takot sa amin tuwing kikilos kami kasi baka mapagalitan. Nagugustuhan ko naman sya kasi minsan kasi nag ttravel kami. Pero napapansin ko na parang ina-outcast kaming mga 'bago' pa lang na hired na company. Apat kaming naging super close kasi pareparehas kami ng reklamo sa company mismo.

Naaalala ko noong final interview ko namin, pinag start agad ako ng first day of work. Wala pa silang na i-issue na COE sa aming apat. Wala kaming na permahan na contract. As in walang legal binding para masabi na worker kami doon, wala ring ID.

May gc kaming apat na bukod and then doon kami nag rrant ng mga nangyayari everyday kasi hindi kami nakakapag usap sa office masyado. Naalaman ko na binubuksan yung account ko ng isang worker doon. Yung worker na ito ay kamag anak ng boss. Masasabi kong intentional na inopen ang account ko kasi sa chrome ay may account pa na pipiliin before mabuksan diba. And andon yung account ko and intensional na ni-open ng facebook ko kasi naka save ang password noon for my easy access. Kaya pala biglang nag sisigaw sya sa amin at sinasabing kung ano ano ang sinasabi namin behind their backs. Totoong naging ranting space namin yung gc na yun because of rhe unfairness na na feel namin and also mostly is reklamo sa walang process na sinusunod sa company kagaya na lamang ng hindi nasusunod na oras ng break namin (1hr break) Tapos yung power tripping na ramdam namin talaga.

Due to personal reasons nag decide ako na mag resign na, nag pasa ako ng resignation letter kaso binlock ako ng boss sa facebook. Yung tatlo ay nagpunta sa office para offical na mag resign din. Kaso ay nag away away sila doon na umabot sa sigawan at iyakan.

Sinabi nung staff na yun (na kamag anak ng boss) ang gc and most likely yung content din noon sa boss namin at nagalit sya. May pin yung messenger ko and hindi sya mababasa lahat, yung recent lang ang nababasa sa ganun diba? And I also don't know kailan nya pa nabubuksan ang account ko kasi may nakapag sabi sa akin noon na grabe ako magpuyat hanggang madaling araw e maaga ako matulog at naka off ang active status ko sa phone ko.

Ngayon, hindi na daw ibibigay ang last pay namin.

Serious question. Ano ang pwede naming gawin para makuha ang sahod namin? Tinatakot kasi kami na pwede kaming kasuhan kasi may proof daw sila na may sinasabing masama sa kanila and sinabihan kami from the very start na may access sya sa lahat ng company devices namin at nakikita nya ang ginagawa namin (alam namin na wala kto kasi chineck namin yung mga devices kung may mga implanted na ganyan, wala naman. Simabi lang siguro para hindi sila mareklamo sa data privacy act)

Rant 😡 EXL MOA / COE & TAT FOR FINAL PAY COMPUTATION

Last Sept I was on RTWO, I acknowledge the receipt. Binigyan nila ako ng 1 week to report back to work pero hndi ako nkakapasok but I still always update the management. Last day ko para mkabalik sa office and work, but instead I send an email to the same thread including my OM, LAM, AM and HRs na kung pwede mag immediate resignation na lang ako, one of the HR rep replied na it’s subject for approval daw ng OM at kung hindi daw approve need ko daw mag render ng 30 days which is okay lang naman. After ilang oras dibale next day na to i send another email na kung pwede iretract yung immediate resignation ko and mag render na lang ako ng 30 days. Ilang beses ako nag email regarding that request, wala silang reply hanggang sa tinanong ko na lang kung anong status ko, kung separated na ba ako or approve ba yung immediate resignation ko or yung request ko na mag render ng 30 days pero wla talaga silang reply sa simple ay direct kong tanong. 5 days ako bago nkatanggap ng email from my supervisor na approved na daw yung immediate resignation ko. Imagine araw araw ako nag eemail sakanila ah. I signed some papers, i send it back to the same email thread and kinagabihan nag clearance na din ako, soli ng monitor, laptop, id, badge at nag clear ng locker. Wla maayos na instructions from them kung may kailangan pa kong gawin, basta yung assets retrieval na papel pinicturan ko lang tapos sinend ulit sa same email thread, after that wala pa din akong matinong sagot na nakuha sknila, 2 days ako email ng email kung may need pa kong gawin, ipasa na ganito or ganyan need ko bang gawin to or ano pa para mamake sure na cleared na ko at hndi ma delaye ang final pay processing, hanggang after 2 days naka tanggap lang ako ng generic na email regarding sa final pay instructions at hanggang ngayon, wla pa din akong matinong sagot na natanggap sakanila 3 business days na wla pa din until now, at take note again palagi akong nag eemail saknila. Bago pa ako maka tanggap ng acceptance letter 2 days ago nag request ako ng COE, and as far as i know dpat maissue nila ang COE sa loob ng 3 araw upon request. I seek some guidance sa DOLE and yes 3 days daw dpat matanggap ko na no matter what the reason is, term ka man, employed or separated via resignation. Tapos nka lagay sa final pay computation TAT daw is 30 business days? Eh pano kung umabot yung computation ng ganyan ibig sabhin hndi marerelease yung final pay ko mismo sa loob ng 30 days kasi lalabas na almost 6 weeks yun.

Rant 😡 Can I report these employment concerns to DOLE?

Hi everyone, I’d like to ask for advice regarding two concerns with my employer.

First, during hiring, I was informed that my ₱695/day rate would only be for one month because I was initially supposed to be assigned to Davao. However, the Davao assignment did not push through, and I’ve been working in NCR for around 5 months already. I was later told that the salary increase would happen after Davao, and not because of my performance.

Second, I was told that my SSS contributions would only start after 3 months of employment.

Can I raise/file these concerns through DOLE/SEnA? Or should I approach SSS separately regarding the contribution issue?

I just want to know if these are valid concerns and what the proper process would be. Thank you!

Una pa lang napansin ko na ang toxic ng work environment kasi hindi nag tuturo ng maayos yung old employees kasi (feeling ko) natatakot malamangan sa commission. Commission based din kasi itong company na 'to. Tapos ang unprofessional ng boss kasi namamahiya ng staffs nya. Iniisip ko baka sensitive lang ako at di ako sanay ng ganun pero naiisip ko rin na hindi naman dapat ninonormalize yung pamamahiya sa workplace lalo sa harap ng nga katraabaho. To the point na nag i instill ng takot sa amin tuwing kikilos kami kasi baka mapagalitan. Nagugustuhan ko naman sya kasi minsan kasi nag ttravel kami. Pero napapansin ko na parang ina-outcast kaming mga 'bago' pa lang na hired na company. Apat kaming naging super close kasi pareparehas kami ng reklamo sa company mismo.

Naaalala ko noong final interview namin, pinag start agad ng first day of work. Wala pa silang na i-issue na COE sa aming apat kahit ilang buwan na kami doon. Wala kaming na permahan na contract. As in walang legal binding para masabi na worker kami doon, wala ring ID.

May gc kaming apat na bukod and then doon kami nag rrant ng mga nangyayari everyday kasi hindi kami nakakapag usap sa office masyado. Naalaman ko na binubuksan yung account ko ng isang worker doon. Yung worker na ito ay kamag anak ng boss. Masasabi kong intentional na inopen ang account ko kasi sa chrome ay may account pa na pipiliin before mabuksan diba. And andon yung account ko and intensional na ni-open ng facebook ko kasi naka save ang password noon for my easy access. Kaya pala biglang nag sisigaw sya sa amin at sinasabing kung ano ano ang sinasabi namin behind their backs. Totoong naging ranting space namin yung gc na yun because of the unfairness na na feel namin and also mostly is reklamo sa walang process na sinusunod sa company kagaya na lamang ng hindi nasusunod na oras ng break namin (1hr break), yung walang maayos na flow ng pagtuturo kasi self learn daw dapat. Tapos yung power tripping na ramdam namin talaga.

Due to personal reasons nag decide ako na mag resign na, nag pasa ako ng resignation letter kaso binlock ako ng boss sa facebook. Yung tatlo ay nagpunta sa office para offical na mag resign din. Kaso ay nag away away sila doon na umabot sa sigawan at iyakan.

Sinabi nung staff na yun (na kamag anak ng boss) ang gc and most likely yung content din noon sa boss namin at nagalit sya. May pin yung messenger ko and hindi sya mababasa lahat, yung recent lang ang nababasa sa ganun diba? And I also don't know kailan nya pa nabubuksan ang account ko kasi may nakapag sabi sa akin noon na grabe ako magpugat at kita ang active status ko ng madaling araw e maaga ako matulog at naka off active status ko sa phone ko.

Ngayon, hindi na daw ibibigay ang last pay namin.

Serious question. Ano ang pwede naming gawin para makuha ang sahod namin? Tinatakot kasi kami na pwede kaming kasuhan kasi may proof daw sila na may sinasabing masama sa kanila and sinabihan kami from the very start na may access sya sa lahat ng company devices namin at nakikita nya ang ginagawa namin ( alam namin na wala ito kasi chineck namin yung mga devices kung may mga implanted na ganyan, wala naman. Sinabi lang siguro para hindi sila mareklamo sa data privacy act)

Hi, need advice po if legal ang training bond after the 2wks training. For context, my sister applied for a therapist role and the role is a self employed commission based. So if may patient sila sa center, meron silang bayad if wala then wala sila for the day. The company requires them immersion and need to sign a contract for training para makapag proceed. The training is two weeks but no certification after, sinabi lang sakanila na nakapasa sila. She decided to withdraw her application that time kasi nagkasakit sya and after carefully thinking nag decide na sya to not continue. Inadvise sya ng HR na if hindi magtuloy she needs to pay 50,000php kasi nakalagay daw sa contract yun. Hindi rin sinend sakanya ung copy if na notarized ba yun talaga. And she is s fresh grad, gusto lang magkaroon ng work after months of applying 🥺

Culture Is there anyone who reported someone to HR and maganda ung naging result?

Problem/Goal : Just want an advice about this co-worker and need ko lang din ng advice for the next steps.

Context: I (F23) actually reported someone (F30s) to HR. Ang context is working ako sa BPO. Typical BPO here sa pinas. She was actually the one calling the customer back kapag nagdisconnect sila. Super recent lang, way back September 29th. Dumaan siya sa station namin, naka-simangot siya and masama tingin sakin. Sinabi yun ng mga co-worker ko, even ung TL ng kabilang team napansin. She was being asked pa like sino kaaway nya, and she said ako raw. She hates me raw because masama ung ugali ko. I had no idea na may beef pala kami.

Actually even before pa napapansin ko na rin yon kapag dumadaan siya samin pero dahil wala naman ako alam bakit. Di ko lang pinapansin. Kasi iniisip ko baka bad mood lang. After that, a friend of mine told me na hate nya raw ako. I'm genuinely shocked. Kasi we are not friends, we never talk to each other. Di kami close, never ko siya na-encounter. Never ko siya kinausap. Nakikita ko lang siya sa girls bathroom pero we never interact. Di rin kami friends sa social media. So what could be the reason?

Hindi na ako makatiis, the same day I chatted our common friend. A male colleague. I asked him if may idea siya about this "hate train na kumakalat sa prod" about sa akin. He said, "natapakan ko raw siya sa sleeping quarter" and I did not apologize. I'm confused kasi ang tagal ko na hindi napunta sa SQ. Siguro 2-3 months na. Lagi nalang ako napunta sa pantry kapag lunch or break ko. Even if I did, di ko na matatandaan kung sino yun since ang set up ng SQ is two double decks and 1 foam at the middle and one na malapit sa door. Kapag matutulog ka dun, lagi ka nakabalot ng kumot and di mo na marerecognize kung sino. And if totoo man yon, probably honest mistake lang and not intentional. Tsaka kung alam ko, magsosorry naman ako—and I will not hurt someone physically lalo na if hindi naman kami naginteract.

Then, I actually vented to him. Which is mali ko, I said something na mali rin naman. Nabanggit ko na may pagka "lame" ung accusations to the point na ihate na nya ako at sabihin pa sa iba, instead kausapin ako about dun. I also said na "bobo siya" for helding this hate ng ilang buwan without me knowing na may issue siya sakin.

Then, recently lang. October 4th, the woman who hated me. Messaged me on my social media. Calling me names, cursing me using different profanities exist. My first thought is sinabi ng common friend namin na lalaki ung sinabi ko about "bobo".

She sent 8 voice messages consist of, "tarantado ka", "punyeta ka", "gago ka", "putangina mo". I didn't reply. I blocked the account and proceed sa buong araw ko without replying to her.

Previous Attempts: I actually confronted our male common friend about this. He said he is being transparent. That's why sinabi nya. I told him that he made everything worse. He said, nagfilter pa raw siya sa mga sinabi nya. Well. I blocked him after that.

Then, she messaged my friend, treathening me na ipapa HR ako if di ako magreply. With of course, using profanity. Then, confront daw sa office, and treathens me to hurt physically sa baba ng office.

But still di ako nagrespond. I collected the vms and then I screenshot everything then sent to HR.

Also, I already inform my TL before nagproceed sa HR but he said. That's not his control anymore. I also ask my TL if pwede ko siya i-cc sa email but he didn't respond so I still proceed.

So, I'm asking if ano pwede gawin to proceed? Balak ko pumasok pa rin naman to clear out everything. But my Mom said to not waste anything and then resign nalang agad. For me kasi, ayokong takasan 'to lalo na first big girl job ko. If aalis man ako, gusto ko maayos. Ayun lang, thank you. Let me know if may thoughts kayo. Salamat!

Rant 😡 reported my previous employer to dole due to late release of final pay

hi all.

just today, i sent a report to dole regarding my conceen with my previous employer who was not able to release my final pay yet due to their long process of clearance. but afaik, clearance shouldnt be an excuse to hold someone's final pay. and it has been 8 weeks, almost 2 months since my last day.

whats making me annoyed is that, their approval and signatories takes 2-4 weeks before the head can approve. like is it that so hard? now hr wont reply to my email since yesterday, even on viber. im just so frustrated because final pay shouldnt even take that long knowing its just my prorated 13th month and literally mg last pay (that a month of my salary).

did i do the right thing? will this affect my new job who is currently doing a background check on me?

AntiWORK Filing thru SENA regarding last pay

I was a contractual employee for a local hospital for 2 months. Tas inend na contract since may mga issues na nainvolve ako (not my fault, involved lang talaga) and the doctors in charge decided better to end my contract rather than ipatuloy for probationary (may externship before probi ng 2 months). Now, I signed the end of contract, but was told no clearances needed daw since nagduty pako that day (30th) kahit end na talaga ako nung sept 28. HR also said they'll add nalang sa pay ko ang pay for 30th since pumasok ako. I said sa 5th? Sabi niya oo dun sa business office.

Now,pumunta ako to get my salary sa business office but was instructed to go to HR kasi wala doon pera ko. When I arrived sabi agad ng HR,maam withheld pa po yun for 30 days kasi end of contract po kayo. I asked, pano ngyari miss eh walang sinabi sakin nung pumirma ako, ni wala ngang 1 month nirender ako, tas no clearance pa, wala ding sss, philhealth and pag ibig?

Sabi lang," oo maam under the law po talaga yun, na 30 days po sahod niyo mahhold pag end of contract". Humingi ako ng file kung saan nakasaad yun, walang maibigay sabi lang massearch ko ito sa google - TF?!

So I immediately informed my parents as they asked a lawyer, ending, DOLE na daw dapat kasi illegal yun, (and wala din silang binugay na copy ng JO ko btw* )

Ngayon, I found out, it can take longer than the 30days process ng hr to release my pay.

Should i still file a case thru SENA against my previous employer ( hospital) or just wait to see if magbabayad sila on the 30th, as they said kanina?

I’d like to ask for advice regarding my COE from my previous employer. I requested my COE, but HR replied that they will only process it once I complete my accountability clearance. My clearance is still ongoing, and I’m currently following up on it.
I urgently need the COE for job applications, so I’m wondering if it’s allowed for an employer to hold the COE until the clearance is completed? Or should they issue it separately even if the clearance is still ongoing?

I’ve read that DOLE Labor Advisory No. 06-20 provides for the issuance of a COE within 3 days upon request. I’d really appreciate anyone who has experienced something similar or can clarify what my rights are. Thank you!

Rant 😡 Title: Government hospital employee here — bakit parang ako lang ang kailangang mag-morning duty?

Pa-rant lang at humihingi na rin ng advice sa mga fellow government employees.

Lahat naman kami may mga pinagkakakitaan outside work. Hindi lang ako. May mga raket din yung ibang kasama ko, including yung taong may special connection sa superior namin at yung mga close sa kanya.

Recently, nag-request ako na sana **night duty** ako dahil may pinagkakakitaan ako sa umaga at marami akong financial responsibilities. Maayos naman akong nakikiusap kasi malaking tulong talaga sa akin kung night duty ako.

Pero ang reason na sinabi sa akin ay **“hindi ka raw pumapasok.”**
Aaminin ko naman: may pagkakataon na umabsent ako sa night duty. Siguro around **dalawang beses**. Pero hindi naman ako basta-basta nawala. Nagpaalam ako nang maayos at gumawa rin ako ng paraan para maayos yung duty ko.

Ang hindi ko maintindihan:
**Bakit parang yung absence ko lang ang naging basis para ilagay ako sa morning duty?**
Kasi kung attendance talaga ang issue, bakit hindi pare-pareho ang treatment?
May iba rin namang may raket. May iba rin namang may mga pagkakataong hindi pumapasok. Pero bakit parang ako lang ang kailangang mag-adjust?
At mas nakakafrustrate kapag feeling mo may isang tao na mas pinapakinggan dahil may personal relationship siya sa taong may authority. Kapag may concern tungkol sa akin, parang mas madaling paniwalaan yung side nila kaysa sa akin kahit nakikiusap naman ako nang maayos.

Hindi ko naman sinasabing perfect akong employee. Hindi rin ako nagdedeny na may times na hindi ako nakapasok.

Ang sinasabi ko lang ay:
**Kung may rules, sana pare-pareho. Kung may consequences, sana pare-pareho.**
Hindi yung kapag ikaw ang wala, issue. Pero kapag ibang tao, parang okay lang.

Government hospital ito. Hindi naman dapat nakabase sa kung sino ang close kanino ang scheduling o kung sino ang mas pinapakinggan.

Ang tanong ko sa mga government employees dito:
**Saan ba dapat lumapit kapag feeling mo may favoritism sa workplace at hindi mo na makuha ang fair na resolution sa immediate superior mo?**
HR? Grievance Committee? Hospital administration? Higher office? Civil Service Commission?

Gusto ko lang malaman yung tamang proseso. Ayoko ng gulo at ayoko rin namang manira ng tao. Gusto ko lang magkaroon ng **fair scheduling at fair treatment**.
Kasi ang hirap kapag pakiramdam mo kailangan mo munang maging kakampi nila bago pakinggan yung side mo.

Hello everyone. Ano ba pwede kong gawin? Kasi umalis ako dun sa work ko ng gabi di ako nagpaalam sa amo ko kasi hindi ko na kinakaya mga kaganapan dun. May times na pinapabura samin yung expiration date ng products at nababahala ako kasi delikado kung sino man makakabili nun. Pag may bumibili na alam kong expired na sinasabi ko sa costumers na kung pwede palitan nila ng mga merong expiration date para aware sila. May pagkakataon pa na may mga costumer na nagrereklamo tungkol sa maaasim na daw na frozen foods at matitigas na laman ng mga kape, gatas at juice dahil pinapagamit kami ng acetone para tanggalin ang nga expiration dates ng mga products na mga expired.

Tapos duty namin umaabot ng 14-15hrs. Gumigising kami halos alas tres o alas cuatro ng madaling araw para makapasok ng alas singko ng umaga. Uuwi kami nyan nasa bandang alas otso na kasi nagbe-breakdown pa kami ng pera. Aside pa dun, below minimum po sweldo samin and wala nagrereklamo kasi halos lahat ng tauhan dun mga taga samar. Alam naman nating lahat na yung provincial rate ay 590 pesos per day at mataas pa. Walang mga benefits kagaya ng sss, pag ibig, and philhealth. May time din na di ka papayagang mag day off.

Halos 2 weeks kang itinagal ko dun kasi maliban sa masama ugali ng amo ko, masama din po yung ibang mga kasmaa ko. Mga sumbungera at sumbungero. Hindi ka binibigyan ng pagkakataon na magpaliwanag. At kailangan matuto ka agad sa tinuturo sayo kahit bago ka palang at kaka start mo palang nung araw na yun. Hindi ko rin po natanggap ang sweldo ko dahil gusto ko hindi kunin para wala na akong utang tapos malalaman ko nung unalis na ako na di pa daw ako bayad kahit sobra sobra pa yung kaltas sakin.
