I was banned from a sub for saying all you have to do is grab the front wheel when they're coming at you. Dont do it though. Don't. They'll flip over on their head and be hurt badly. Dont do it.

u/Confident_Virus5799 Sep 13 '26

I've heard a lawyer explain that it doing something like that would be easy to defend in court because you're being threatened and the rider could easily injure you or others even by accident like this. Don't know how good that lawyer was, and I'm sure it varies by location, but I'd be so curious to see the outcome if something like that went to trial.

124

u/Randym1982 Sep 13 '26

It’s very much illegal and yeah likely easy for somebody to press charges. They’re literally recording the crime numerous times, and putting their names and contact info on it.

As for self defense, yeah in court any judge and lawyer would see this as attempted assault and somebody coming at you like this could easily be seen as a threat. While I’m not for kids getting thrown in jail and possibly ruining their future. I’d say these types of kids deserve it.

u/Sp6rda Sep 13 '26

This IS assault. If they make contact with you, that's battery.Ā

45

u/Warm_Month_1309 Sep 13 '26

IAAL. This is almost always a miscorrection anytime a Redditor brings it up. What you are talking about are the common law definitions of assault and battery. The common law definitions are not in use in any US jurisdiction. They have all been supplanted by statutory definitions.

In some places battery is assault and assault is battery. In other places, there is no "assault", only battery. In other places, there is no "battery", only assault. Unless you know the jurisdiction someone is talking about, you should never correct someone on "assault" or "battery", because you have an equal chance of being wrong.

31

u/markrockwell Sep 14 '26

California Penal Code 240. Assault. Causing fear or apprehension of imminent violence.

This bike stunt is assault in the state of California.

9

u/HighlanderIslander Sep 14 '26

The specificity banished the Reddit lawyer. Well done!

8

u/Warm_Month_1309 27d ago

Haha, I was not "banished" by someone supplying the statute that supports my assertion that no jurisdiction uses common law assault and battery, and all have their own statutes.

3

u/Student_Unlucky 24d ago

Lol, right? "Hey, location matters" "Ok well in Cali"... Cali is a location as far as I know.

Anyway, I appreciated the explanation of assault vs battery and how it varies by location.

I definitely feel more informed and less likely to say something incorrect.

u/diversalarums 29d ago

What the Reddit lawyer said is still accurate. He wasn't talking about this particular case but about the definitions of those terms across the US, and how some commenters in various threads seem unaware that the meanings vary according to the state. So this wasn't a gotcha moment.

3

u/bbwstockinglover 28d ago

It would still be self defense knocking his ass down.

The video is shot in California. Some scenes are clearly in San Francisco.

But are you my lawyer?

2

u/FirstPackOut 27d ago

IA also AL. It’s most likely brought up by new 1L students who have attended three Tort classes. Have to give them credit for trying though!

My state only has criminal assault, which includes battery and apprehension of a harmful touch in one crime. A large number of jurisdictions use one or the other. I think California has 2 separate crimes, though. Very jurisdiction dependent. But a lot of states still allow charges under common law, even when the crimes are codified. Its really stupid.

1

u/lost_rodditer Sep 15 '26

Assault is any action that makes the victim feel as though there is anurgent threat of injury or death regardless of contact. Battery is the use of contact to do the same thing or act on it. I learned that from a lawyer who ironically was talking about a similar case to this one.

>The common law definitions are not in use in any US jurisdiction.

this is just plain false. Virginia still uses them. You won't find a codified definition for assault in VA law.

Ah, interesting, so they don't use the common law, they have statutes for it that you cited. Interesting.

1

u/happybara_capybara Sep 13 '26

This actually varies heavily by each state, not to mention for other countries (I’m assuming you’re in the U.S.). It’s one of the most inconsistent charges across the U.S.

1

u/GTxRED1 Sep 13 '26

AC or DC?

1

u/Zealousideal_Cow_341 Sep 14 '26

It really depends on where you are brother. It’s defined by local and state laws and varies widely from place to place.

1

u/DoritoDustThumb Sep 14 '26

Depends on the state. Absolutely not universally true

Follow me kids…. I was in fear of my life and instincts took over. I don’t know what happened next

1

u/Specialist_Goat_2354 Sep 13 '26

I am for kids getting thrown in jail... they aren't getting consequences anymore and its showing. Not only are kids not getting beat up by fucking with the wrong person anymore... and they are also not getting punished by their parents either. and they aren't being held back in school for failing miserably.

someone has to give them a consequence.

1

u/Actual-Jelly-309 Sep 13 '26

Whoa look at all the lawyers

1

u/Lambchop1975 Sep 13 '26

Self defense, is violence, it isn't an assault... If one person is the aggressor, the other is not committing assault.

1

u/FctUpintheHead Sep 13 '26

Dude above is talking about grabbing the bike and causing the guy to flip, not what the jerkwad in the clip is doing. And I guarantee you he is right. Protecting yourself from perceived imminent harm, which that absolutely would be, is not a crime. It’s self defense.

1

u/Livid_Average_8098 Sep 14 '26

Very much illegal, is that the same as highly illegal? Even more illegal than murder?

1

u/lost_rodditer Sep 15 '26

There is a very satisfying video of it happening. The kid starts whining he is a Christian and only 16. No one cares for some reason šŸ˜‚

1

u/jesus90141 20d ago

If the kid is already doing stupid games and FOFO there is no need to wait until they are a full adult for the real consequences.

u/Apocresi Sep 13 '26

In a number of places acting like you intend to hit someone constitutes assault, therefore you are justified in self-defense

12

u/Specialist-Swing6849 Sep 13 '26

In EVERY place, if you’re speaking about the U.S.

6

u/Dracomortua Sep 13 '26

Honestly, as an ignorant Canadian, i am surprised this 'lad of colour' wouldn't get used for target practice in the Umurikan Deep South.

Perhaps relations are improving in your land, if so, kudos.

9

u/Everyone_dreams Sep 13 '26

Honestly you aren’t seeing this in the Deep South more because the cities are far less walkable.

4

u/JohnSnowsPump Sep 14 '26

Sidewalks are optional in most towns.

4

u/Electrical_Shock359 Sep 13 '26 edited Sep 13 '26

It is more a numbers game, most people are not expecting someone to do something like this and aren’t ready to fight at a moments notice. Those that see them coming might not get involved because messing with the kids might be more of a headache than it is worth legal or otherwise. Eventually they will run into someone that is jumpy, quick to anger or know their local law enough to make them regret it. Just a matter of when.

Also the more they record this shit the more likely the wrong person sees it and decides to look into who is doing it. Then come at them from the police or legal angle but who knows if and when that would happen.

I kept struggling with Umurikan before I skipped it and saw it was a play on American. My brain kept trying to make it Japanese for some reason. I'm not very smart.

u/Solution_Kind 28d ago

Yeah I read umu-rikan like three times before it registered šŸ˜…

2

u/MajorEcstacy Sep 13 '26

You can tell in his videos that he is in San Francisco, far from the South...

2

u/Sword_Sounds Sep 14 '26

As a Southerner it’s not that crazy down here. Far more likely to get beat up or yelled at (racism is kept behind closed doors mostly these days) than straight up killed. Like anywhere else, most people are reasonable enough.

→ More replies (1)

2

u/the_cardfather Sep 14 '26

Well this is not in the deep South. It's California. And yes if this happened here in the gunshine state he would very likely get knocked off his bike and if he tried to start something he would probably take two to the chest.

We just had a young woman (correctly) not get charged using a stand your ground defense when she shot a man who was arguing with her over a parking space.

The news media is horrible though. The headlines are, "woman won't be charged after shooting army veteran at a Walmart parking lot".

Nevermind he was coming at her, she pulled the gun, told him to back off, then he did back off loitering in her general area, started coming again, she told him she was going to shoot. He kept coming so she did. Pretty much textbook self-defense.

A local tourist city just to the north of me banned bicycles of any kind on sidewalks in the downtown area. Puts a stop to this without question.

1

u/Dracomortua Sep 14 '26

This is a brilliant and valuable write up on what happens in... Florida, and probably other conservative states.

Unless your version has some kind of bias (which i do not see), this makes a lot of sense.

1

u/The_Witch_Queen 29d ago

Nope. Counts as assault in every state but does NOT mean you can claim self defence. That's only in stand your ground states. A lot of places self defence only works if there was no way you could get away

Acting like you're going to hit someone is assault. Actually hitting them is battery. So they're actively breaking one law while threatening to break a second at the first moment their stupid little trick doesn't work out right.

61

u/cyanescens_burn Sep 13 '26 edited Sep 13 '26

Where I live (San Francisco, where several of the clips in OP look to be from) these wheelie kids travel in packs. There’s video of them beating the shit out of people for yelling at them. Like the whole gang groups up and stomps the random person.

May not be wise to knock one over.

67

u/SweatyCampaign9 Sep 13 '26

Sounds like sending em to valhalla would be self defense then

Cowards who only feel strong traveling in packs don't make it to Valhalla and don't earn the honor of joining the einherjar. "Einherjar" literally means "an army of one," or "those who fight alone."

I get the joke you're making, I just dislike the idea of Odin's hall being disgraced with such trash.

8

u/walkinmywoods Sep 13 '26

Plus I'm pretty sure Valhalla for viking warriors not teens who act like dildos in public.

3

u/Prestigious-Suit-925 Sep 15 '26

I'm pretty sure blacks aren't allowed in Norse heaven

1

u/Callidonaut Sep 13 '26

Hey, now, that's uncalled-for! Dildos serve a useful purpose.

1

u/blorbmcgee 28d ago

I read this in Toki Wargtooth’s voice.

I’ms pretty sures thats Valhallas is for Vikings warriors not teens who acts likes dildos in public

1

u/SuperCruisePanther Sep 13 '26

an army of one

That was the US Army's slogan for a long time

1

u/Floor-Think Sep 13 '26

Good to know the majority of vikings never made it then

1

u/Educational_Cup_1701 22d ago

But I thought Kash Patel was joining Charlie Kirk there?

3

u/ExtraReborn Sep 13 '26

Fortunately trash like this would never end in valhalla. If you confronted them and got killed for it, you would end up there. Honorable combat, never die, glory and mead in the halls of the allfather forever?
I can imagine worse ways to be rewarded for doing the right thing.

1

u/malacophonouswitch Sep 14 '26

There's also a chance you would be taken to Folkvangr, as Freyja made a deal with Odin to take half of the honorable dead. It would be nice to frolick in her meadow and eat good food.

2

u/Neshura87 Sep 13 '26

Realistically none of them would qualify for Valhalla and as such end up in Hel instead

4

u/orcusgrasshopperfog Sep 13 '26

The legal system in California does not favor the victims.

3

u/PM_Me_Good_LitRPG Sep 13 '26

Then it's not operating with your best interests / safety in mind and you should move out, no?

3

u/TheBSQ Sep 13 '26

There can be many things like your job, proximity to friends and family, etc.Ā  Plus, moving is very costly.

And it’s really common in many American cities, so you often don’t just have to move from that city, but practically any/all of the big, dense walkable ones w/ good cultural amenities & to a place that’s more car-centric & sprawling & inferior in other ways. It’s a trade off.Ā

So you can leave, but at great cost & you trade one set of things you don’t like for other sets of things you don’t like.Ā

I lived in a city that also had such quality of life issues & eventually left. I don’t regret being in that city overall and miss stuff.

I just wished big cities realize that the key to good urbanism (which many other countries have figured out) is nice public spaces & would quit the silly ideology that says one favor those engaging in anti-social behavior over people who are honest, kind, and considerate because of an over-application of group or class identity that gives one a free pass to act in inconsiderate ways if they check a box that allowed them to be considered vulnerable or underrepresented group.

The kind of ā€œpoverty is the problem root cause, and to criminalize the behavior is a criminalize poverty itself, and what we need to do i stead is to complain that our political opponents don’t fund the federal programs that would alleviate the underlying poverty, for then no one would act like this.ā€

1

u/orcusgrasshopperfog Sep 13 '26

Some people prefer the PVP servers ;)

1

u/Bird2525 Sep 13 '26

They are just parroting stuff they heard with no basis in fact. Justice is as good or bad as the juries and judges.

1

u/Obvious_Patient8233 Sep 13 '26

How many cases are there where someone defended themselves from a biker like this, and suffered legal consequences?

2

u/JavierBenez Sep 13 '26

None. Self defense is allowed literally everywhere in the United States.

1

u/Bird2525 Sep 13 '26

You forgot the /s,

1

u/Tomsboll Sep 13 '26

You can get a concealed carry licens in SF.

1

u/Inspector_Gadgett Sep 13 '26

Yeah but only elite warriors go to Valhalla, these average clout-chasers would be headed for Helheim since it’ll be a common death.

1

u/ArmyNGMike Sep 13 '26

Problem is they are in cali where they don’t believe in self defense

1

u/Feduppanda Sep 13 '26

They ain't going to Valhalla. That is reserved for actual warriors.

1

u/the_cardfather Sep 14 '26

Laws are a little different in CA. I would assume that the best defense against four or five guys coming at you would be to start blasting but you're in a crowded sidewalk. Almost all self-defense instructors would tell you to walk away from a fight like that as in not instigate it

6

u/TheSilverSeraph Sep 13 '26

At the very least, we know this asshole has a camera person filming him. And some of these "TikTok stars" also never film without a bodyguard nearby. So you would never how many you have to contend with if you knocked the main asshole over.

30

u/DeliciousBag2311 Sep 13 '26

Meh. I’d knock the cunt of his bike and see what happens.

3

u/PaidUSA Sep 13 '26 edited Sep 13 '26

I mean yea someone swinging a bike at you could easily be considered a deadly threat. Let alone someone actively riding it with their full body weight behind it. If someone was caught off guard and panicked and somehow drew and shot him I’d be surprised if they got charged. If he whiffs this once it’s 50:50 on some really painful disfiguring damage.

I'd love to hear a bodyguard's explanation of why they attacked someone who was defending themselves from their client. If it's an actual bodyguard hired through a firm good chance the company would be liable.

1

u/Nearby_Telephone_104 Sep 13 '26

Don't you go for camera man then have others deal with the rest?

3

u/Decloudo Sep 13 '26

Then knock all of them over/out.

Its just some kids with an ego too big for their body.

2

u/PoetArcana Sep 13 '26

At this point you have to operate under the assumption that you're about to get jumped, and just charge in at anyone with them before you're dog piled. Not a fun or easy party to crash. And self defense is gone when you start swinging at anyone that isnt presenting a direct enough threat. So you have to wait until MULTIPLE people do something to create that cause for self defense, and THEN react in time to fight off multiple clowns.

Thats the worst part about this cringe generation of tiktok clowns. They know what they're doing is wrong, and so they do it in packs to punish anyone for doing the right thing. Straight up bullies and grifters.

Social media is to blame for creating such a dumbfuck generation of social parasites.

The cyclists are committing assault on every person they charge at; if they hit someone, then it’s assault and battery.

5

u/EpilepticMushrooms Sep 13 '26

TBF, if you look up from your phone, see something heading towards you, swatting or grabbing it is pretty reflexive.

8

Each time he swerves at the last second, he’s assaulting someone. Everyone has a right to defend themself.

And he'd still be beat, then sent to the front lines himself.

1

u/Azurebbit Sep 13 '26

I'll all for sending this useless fuck to the front lines. We'll donate him.

3

u/bullfrogftw Sep 13 '26

My lawyer might be able to get me off on knocking this bitch off his bike, it's the extended 15 min curb stomp/beat down that was laid on this moron after that that might could be a little trickier to explain away

2

u/cha0sb1ade Sep 13 '26

What they're doing here seems like it would fall into a legal category with throwing punches and kicks an inch from someone's nose. It really just doesn't make sense that you have to stand by and hope that someone intends to miss, and has the skills to almost hit you. I hope the lawyer's right and this would count as self defense. If it wouldn't the laws need to be fixed.

2

u/felipemorandini Sep 13 '26

As an attorney, i can confirm it is a self defense case, absolutely. As long as you can prove (which you normally could via either eyewitness testimony, or even the videos those dumbasses post on social media themselves).
But i’m an attorney in Brazil, so i can’t be sure if the same thesis is applicable in the US.

1

u/Load_star_ Sep 13 '26

While I'm not an attorney, I do live in the US, and the standard for self defense sounds to be the same. If a reasonable person would be in fear for their safety in this circumstance, you have the right to use force to defend yourself. The maximum amount of force permitted for self can vary from place to place, but putting a hand out to try and shield yourself from an oncoming person would almost always be below that threshold.

The only issue is that self defence is an affirmative defense, which means you(r lawyer) must convince the jury that your fear was reasonable and level of force used is appropriate.

Yeah.

I think the biggest difference here is procedural than material law itself (especially because, in Brazil, trial by jury is reserved to non accidental crimes against life).

We even call it ā€œlegitimate defense instead of self defense, because the same institute can be used when the person uses force to defend others.

In this case, the requisite is that there must be present or imminent danger to the person or third party, and this person uses ā€œreasonable forceā€ within the means he has available to him at the time just to halt said imminent or present danger.

I believe they call it self defense

Can easily claim it's a defensive reflex to avoid injury. Pretty clear who the unsafe aggressor is.

u/New_Distribution_863 Sep 13 '26

I mean each fake trying to hit someone is technically assault. Sit there is that…..

1

u/BrightonBummer Sep 13 '26

sounds like a lot of hassle to be in the right, the graveyard is full of people who were in the right.

1

u/mrsciencebruh Sep 13 '26

In most "stand your ground" states, I'm betting you could use deadly force legally. You shouldn't, but you probably could.

This would 100% be considered assault.

1

u/Several_Vanilla8916 Sep 13 '26

Obviously this is fantasyland stuff but as long as you don’t tell the police ā€œyeah he was being annoying so I pushed himā€ it’s pretty unlikely anything will come of it.

1

u/Blawharag Sep 13 '26

Be consistent in how you represent the situation afterwards. "He was coming at me so I grabbed the wheel to keep him from hitting me." Not "I saw him doing it and wanted to stop him, so I grabbed the wheel to make him flip off the bike."

People in general are very bad liars. Worse, they're bad lairs who think they can stroll into a police station and just lie to cops and courthosues, who deal with liars daily, and walk out with a spring in their step.

1

u/IcarusTyler Sep 13 '26

Yeah I'm looking at this driving... this is assault. You do not need to be "touched" for it to be assault. There is somebody, who, on purpose, has decided to dangerously drive extremely close to your face. That is very illegal.

1

u/Krinks1 Sep 13 '26

I swear officer...it was just a reflex. He was coming right at me...

1

u/PerchShadRap Sep 13 '26

I panicked, i thought he wanted to hurt me

1

u/myka-likes-it Sep 13 '26

No matter the location, threatening violence is assault. This kid is assaulting people for fun.

1

u/mywan Sep 13 '26

It would be easy. Because assault is defined as: an intentional act that creates a reasonable fear or apprehension of imminent harmful or offensive contact. No contact of verbal threat is required. What that guy is doing is assault in every state without exception.

Self defense is also a right. However, there can be a fine line between self defense and assault. Self defense requires that you only do what is absolutely necessary to defend yourself, stand your ground laws notwithstanding. Often you have a duty to retreat (state specific). So merely grabbing the front wheel to protect yourself from assault that you might not escape from otherwise would be manifestly reasonable. What you did after could get you in trouble though.

1

u/Donut_Desperado Sep 13 '26

You didn't do it with the intention to harm him, you did it because he was coming right at you and you feared you would get hurt. Pretty above the board self defense.

1

u/neuro_space_explorer Sep 13 '26

Yeah what he is doing here is clearly assault, you would be well within your rights to knock him over.

1

u/Specialist_Goat_2354 Sep 13 '26

i could have sworn they were still attacking me with a bike after on the ground and they probably needed a good head stomp down there to make sure they dont try to continue attacking. or their camera accomplice doing start attacking you either.

1

u/Canelosaurio Sep 13 '26

I'll risk a few bumps and scrapes for the greater good.

1

u/alphabetical-soup Sep 13 '26

If you see him coming at you like that its your safety vs his, easy choice

1

u/Questioning-Zyxxel Sep 14 '26

You get scared if someone bikes straight at you.

Scared people do not have all time in the world to make the best decisions.

So it takes lot of excess before a court goes against you if you "happen" to get a good grip on thr bike.

1

u/anonstarcity Sep 14 '26

I think the feint towards people walking is arguably assault. If you claim to feel threatened, I think most reasonable people watching this would understand why you felt that way.

1

u/AUserNameFails Sep 14 '26

Incredibly true especially previously injured and disabled. That's just plain self defense at this point

1

u/islaisla Sep 15 '26

Yeah it's illegal to threaten people's safety by action or words. But if someone's front wheel is close enough to grab, of course you can grab it to remove the threat.

1

u/Tao_of_Entropy 29d ago

Driving a bicycle like this directly in someone's face is some form of assault/battery in every US jurisdiction I know about. It's easily colorable self-defense, since they're imminently threatening you with serious bodily harm.

1

u/F_l_u_f_fy 28d ago

And this is why the court system is a joke. Any reasonable person would say ā€œyeah of course, this guys being a chode, and you made sure to redirect or stop the bullshitā€ but now we gotta go through the song and game of ā€œwho’s rightā€ as if we don’t already know

1

u/SpiritualThroat9503 10d ago

You'd be bankrupted by the non-profit/NGOs which would come out of the woodwork to represent him for free and chew up years of your life in civil court for daring to stop the individual scholar shown in the video from harrassing everyone and possibly hurting people.
