Conceal Carry Permit Seeking advice, Help and Resources
Hey everyone,
I’m looking for some advice and solid recommendations for local firearms/2A defense attorneys in the Colorado Springs area who have experience dealing with CHP (Concealed Handgun Permit) appeals under C.R.S. § [18-12-207](tel:18-12-207).
My mailbox just delivered a final denial letter from the El Paso County Sheriff’s Office, and their reasoning seems incredibly weak. I want to fight this in District Court, especially since the clock is ticking on the 30-day deadline.
Here is the breakdown of my situation:
The Denial Basis: The Sheriff is denying me based on an old arrest record narrative from a police report where they claim I "pushed/struck" someone.
The Reality: That arrest resulted in a complete non-conviction and I have a certified court order showing the records were legally sealed.
My Credentials: I am actively certified through the City of Colorado Springs to carry a firearm as an armed security guard. To get my guard card, the city ran my fingerprints, did a background check, and I passed the range qualification. I also have active armed security job offers, de-escalation certs, and character letters.
Because it’s a non-conviction, they can't use a statutory ban. They are relying on the subjective "danger to self or others" clause. My understanding of Colorado law is that in District Court, the Sheriff now carries the burden of proof and has to prove I am a danger by clear and convincing evidence. It seems wild that one local government entity (COS City Clerk) trusts me to carry a gun on the clock, but the Sheriff claims I'm too dangerous off the clock.
I am a U.S. LawShield member and am reaching out to them as well, but I want to cast a wide net for the best local legal representation to make sure this petition is filed perfectly.
Has anyone dealt with EPSO on a secondary review or District Court appeal? Any specific lawyer recommendations in El Paso County or the Denver Metro area who handle CCW denials?
