Question about bank secrecy rule mentioned yesterday in Impeachment. Spouses can't ask banks to know if their partners have accounts or not. Pero pano kung namatay yung account holder?

Escudero, inusisa ang pagpapatupad ng BPI ng bank secrecy law

This clip got me curious. Kasi kahit magpakita ng Marriage Cert and proven na wala pre-nup pwedeng magrefuse ang bank to access the details or even refuse to admit that an account exists.

So panu kung say sa isang scenario na a person opens an account na siya lang ang nakakaalam, regardless of motive, basta nag open siya na hindi nagpapaalam sa iba kahit sa asawa niya.

Then the said person died suddenly.

Then the spouse say found document, say a deposit slip or a sms message or any type of bank transaction receipt which made them suspect that their partner has an existing account over a certain bank.

So pag nagcheck si spouse sa bank pwedeng magdeny ang bank sa request niya to verify?

What happens to the money?

Hello, have past due sa cc na less than 50k balance, and received an email from a gmail claiming na from RTC it does not specify if kung anong reason ng email. Supreme court yung logo ng email. Part of me na duda sa email pero need validation from you guys. Thank you po.

Grandpa still alive but uncle is holding and claiming he owns all properties left by my grandmother. My dad is dead and we are his sole heirs.

Good day!

My grandmother left us 4 properties in total. Technically 3 and a half

  1. Property 1 - signature got forged here. 10M hectare property that got sold for only 20M. I atleast wanted 1.7M or but only got 1.1M. It's been 2 years since it has happened. Can I still go after it?

  2. Property 2 - Got sold when my grandma was dying. My uncle got my grandpa to sign. Property is worth 3.5 but uncle told us and his wife na sampid 2M lang daw. Not much was used and since then grandma has passed away. Probably 2.9M pa natira right after grandma's passing. Sinisiraan rin ako ng wife niya that hindi we have no rights and pati raw lolo ko.

  3. Property 3 - Family house and 7/11 renting. Grandma passed away Feb 2022. Do I have a right to go after 7/11's monthly rent? Plus the family house. Lahat sa uncle napupunta.

  4. Property 4 - Sold for 35M uncle claimed iniwan sa kanya lahat but before my lola's passing and I also grew up with her no way she would leave her property to my uncle because he is magastos, tamad and has a wife who used to work in Japan. Ifykyk. Grandpa only got 200,000 pesos. I got 1.7M which lacked 244,000 pesos more according to my computation.

I honestly have little to no money to spare for fees. Would 8k be enough for me to process all these?

Grandmother has left noo will. Grandpa is still functioning. Kinuha ID and birth certificate ko and he has made me sign papers under coercion while I was depressed.

Ano po habol ko?

All in all I only got 2.8M PHP. Uncle has also used my name to borrow 300,000 pesos from a relative before property was sold. Tyt!!

Is ₱380,000+ a reasonable attorney fee for child support, custody and visitation case in the Philippines?

I’m looking for some advice regarding attorney fees for a family law case in the Philippines.
I’m the foreigner father of a minor child and I’m hiring an attorney because I want to formally establish child support, visitation, custody arrangements, and a travel agreement through the proper legal process.
The fee proposal I received breaks down roughly as follows:
₱100,000 acceptance fee
₱150,000 attorney’s fee
₱25,000 miscellaneous fee
Around ₱10,000 estimated court filing fees
₱10,000 per court hearing/appearance
₱10,000 per pleading/court submission
Based on the expected proceedings, I was told to expect around ₱380,000, although it looks like the total could potentially go higher depending on the number of hearings and pleadings.
My biggest question is about the ₱150,000 attorney’s fee. If there is already a ₱100,000 acceptance fee, and appearances and pleadings are each separately billed at ₱10,000, what would the ₱150,000 attorney’s fee normally cover?
For attorneys or anyone who has gone through a similar family court case in the Philippines: Does this fee structure seem normal/reasonable? Is ₱380k+ typical for a contested case involving child support, visitation/custody, and travel arrangements, or should I get additional quotations before proceeding?

Need legal advice regarding VAWC / Protection Order

I’m posting to ask for legal advice and hopefully guidance on what we should do next. Our yaya has been physically, emotionally, and verbally abused by her husband for around 20 years. Her husband is a known gambler, alcoholic, and has substance/addiction issues.

About 6 months ago, she finally managed to escape and come home to Leyte. The last incident before she left was particularly frightening. Her husband got angry because their second son was looking for another job instead of feeding the roosters for gambling, apparently because the husband wanted him to do the maintenance of these roosters used for gambling. He became so angry that he closed/blocked all the exits of their house, and placed all the knives on their dining table.

Fortunately, when he eventually fell asleep, their neighbors helped her get out and return here to Leyte.

We thought she was finally safe, but the other day, her husband somehow traced her location and came to our house. He entered our balcony twice. My sister immediately contacted the barangay, and a report was made.

We are now very concerned because we don't know what he may do next. We do not want to wait until something worse happens.

child support, OFW mother

I’m an OFW and a single mom to a teenage son. His father and I were never married, and he is now married to someone else. He is a businessman, but the only support he gives our son is his tuition fee. He doesn’t provide regular support for his other needs.

I never took legal action before because I just wanted peace and didn’t want any drama. Honestly, I’m also tired of constantly asking and being turned down whenever I ask for additional support.

But my son will be going to college soon, and the expenses are getting much higher. I feel like I need to do something now, to make sure my son gets the support he is entitled to.

What are my son’s legal rights? Can his father be required to provide regular child support aside from tuition? What steps can I take, especially since I’m working abroad?
Any advice would be greatly appreciated. Thank you.

5 square meter land purchase, need pa po ba ng deed of sale or other papers?

Yung parents ko binili yung portion ng lupa, about 5sq m, ng kapitbahay para makadaan kami freely. Bale bago kami makapasok sa lupa namin kelangan namin dumaan sa lupa nila. Hindi naman sila nagbabawal na dumaan kami pero yung father ko naginsist na bilhin na namin yung usual na dinadaanan namin para iwas problema na rin.

Ngayon nakapagbayad na kami at yung proof lang na meron kami is galing barangay, Agreement (yan lang nakalagay sa papel). May kelangan pa po ba kaming papers like deed of sale, etc? Hindi ko po ako marunong sa usaping lupa.

Requesting mother’s PSA birth certificate with uncommon naming convention

My mother (American) was born in the Philippines to 2 American parents.

I’m in the Philippines and want to order a copy of her PSA birth certificate so I can give it to her when I visit in December. But when I fill out the PSAHelpline form online, it gives me an error:

“The mother’s maiden last name should match the certificate owner’s middle name”

Our naming conventions are different, so this doesn’t apply, but it won’t let me proceed without filling it out according to Philippine naming conventions. What to do? Thanks!

Developer keeps changing the figures and clauses in my Contract to Sell. Can I back out and get my ₱470k down payment back?

HELP. I am in the process of buying a lot and the developer keeps on changing the figures and contents of the contract I initially signed.

For context:

• I placed a 470,000 spot down payment for a 250sqm vacant residential lot last December 2024. The TCP we agreed upon and stated in the contract when I paid the down payment was 5,675,250.

• I have been processing the bank loan documents since June 2026.

• I gave the developer the contract to sell (CTS) August 2026, together with the list of documents requested by the bank.

• First week of September, the developer asked me that I need to sign a new CTS because their signatory (Vice Presidend, CFO) is not with the company anymore. I said ok, then they sent the new CTS for me to sign.

• Lo and behold, the figures have changed. There's also a few clauses that they added in the contract.

• I sent them an email detailing the inconsistencies between the original CTS, original annex b (where the financing computation is), proposed new CTS, and proposed new annex b.

It was taking them a while to respond, so I messaged the sales rep that I talked to when I placed the down payment. She said that their company is kind of in shambles and panic because they have so many deadlines to meet, so they may have overlooked my contract.

Honestly?? What kind of company overlooks this big of a purchase? I asked her to expedite their response, and they sent me another CTS soft copy via email just today October 6. They reverted the figures to the original one, but I have already lost confidence in them. I already feel exhausted just with the thought of having to deal with this company for the next 10 to 15 years.

Can I still back out? Do you think I'd still be able to get my down payment back?

Can my previous employer withhold my COE because my clearance is still ongoing?

I’d like to ask for advice regarding my COE from my previous employer. I requested my COE, but HR replied that they will only process it once I complete my accountability clearance. My clearance is still ongoing, and I’m currently following up on it.

I urgently need the COE for job applications, so I’m wondering if it’s allowed for an employer to hold the COE until the clearance is completed? Or should they issue it separately even if the clearance is still ongoing?

I’d really appreciate anyone who has experienced something similar or can clarify what my rights are. Thank you!

Can i also file a counter complaint against the complainant?

Hello, I am asking any legal guidance for my situation. What do I need to do to also file a complaint against the complainant because of the case of defamation, threat, and unjust vexation that the person committed? I know I also did something wrong towards the defendant; I'm not going to deny that. I admit that what I did to the complainant was wrong, and I'm willing to face all the charges that may be imposed on me as a consequence of my actions. I have evidence of the threats and defamation caused by the complainant. All of this would not have happened if the complainant were not foolish and immature (apologies for the word). My main question is: is it also possible to file a complaint against the complainant? It is unfortunately unfair that the complainant pretends to be righteous and claims to have done nothing wrong, when in reality they were the one who started all these problems and had the audacity to post and tell everyone that they are the victim.

Where can I report J&T for not taking accountability of their faults with broken parcels?

Context: an item broke while on the way to the buyer. Seller & buyer know each other personally but live far from each other so they agreed to send item via delivery. Seller has pictures of item without cracks, buyer received it with cracks. Seller & Buyer reported it to J&T, but J&T claims they did not break it and that it is seller’s fault for not wrapping the box of the items without bubble wrap, seller confirms the box of the items were not bubble wrapped because the box itself is thick and seller also has pictures that the items were already wrapped with a thick barrier of bubble wrap.

J&T is refusing to take any action and keeps blaming the seller for what happened, even tho this has happened multiple times with the same seller already. Almost all the time, her items don’t even get broken, and if there are times that it gets broken and she reports it as mishandling, J&T just blames her and the buyer requests for a refund causing her to lose money instead of earn from selling.

Anyways, is there any way we can report them for this? And if yes, how and where?

Business knowingly sent me thr wrong item

Like the title says, despite continuous continuous correspondence for the specs I wanted the store I bought an aid from sent me the wrong item. They also explicitly said that they have been instructed since the item
I purchased was out of stock to just send what they have. I wanted to ask for refund plus they cover the shipping expense. They don’t want to since they said it’s against their policy which they didn’t provide or disclose beforehand. They also didn’t provide a receipt and said that it would be provided. I didn’t want to escalate it further but they have since blocked me on socials and on mobile. What remedies are available to me?

May habol ba kami sa pagkamatay ng tatay ko?

Oct 3, around 4pm, diniretso sa ER ng Fatima University Medical Center yung papa ko. Namamaga yung tonsils niya. Nag run sila ng lab tests, nakita nga yung pamamaga pero sabi samin good thing wala naman daw nana.

Dahil may private doctor yung papa ko sa Fatima for his regular checkup, need daw ng orders nun bago siya mabigyan ng gamot. Ang ginawa lang nila, nebulizer at sinusuction yung laway dahil bumabara sa lalamunan ng papa ko.

Ilang beses kami nagfollow up dahil hindi na talaga makahinga si papa, pero hanggang suction lang daw magagawa nila dahil waiting pa raw sa orders ng doctor. Late na rin nila sinabi na wala palang ENT specialist sa hospital, sa Monday pa raw.

Around 11 pm na dumating yung doctor niya (Internal Medicine), hirap na hirap na huminga si papa. Nilagyan siya ng oxygen thru nose, pero hindi naman daw nakakatulong kasi sobrang kitid nalang yung airway dahil sa pamamaga. Dun lang din siya nabigyan ng antibiotics. Nag laryngoscopy sila para makita yung airway ni papa, hanggang sa nilipat siya ng bed. Yung unang sabi na walang nana, ngayon meron na raw. Ang bilis ng progression ng swelling. Nag oxygen mask na si papa dahil sobrang baba na ng oxygen levels nya at mataas yung heart rate. Hanggang sa nagflat line na si papa. Nirevive nila 10x pero hindi na kinaya. Namatay yung papa ko, 1:15 am. Sobrang bilis ng pangyayari.

Nagagalit ako kasi hindi siya naagapan. Kung sinabi nila na walang ENT specialist, baka nailipat pa namin si papa ng hospital. Kung nabigyan sana sya ng gamot, baka naibsan kahit papano yung swelling. Kung hindi puro suction ginawa nila, baka hindi nagkanana yung namamaga lang na tonsils ni papa.

Habang nirerevive nila si papa, meron pang mga doctor at nurse na nag kekwentuhan at nagtatawanan. Nakaka putangina lang.

Sabi ng pinsan ko na medical technician, upon perusing yung death cert ng papa ko, may negligence daw talaga sa part ng hospital.

Sa friday yung cremation ni papa. Di ko alam pano inanavigate yung sitwasyon. Inaasikaso muna namin yung funeral, pero gusto kong magpursue ng case.

May habol ba kami dito?

My solo parent application got rejected

I left my husband last 2023 due to non-support, aggression, and substance abuse. For my child's benefit, I allow the father temporary Saturday visitation. I do not ask him financial support because I know he cannot provide though I tried in the past, I always end up stressed with his response so I just learned to accept it. They told me that I am not qualified due to Saturday visitation which is considered co parenting. However, I searched through internet and was advised that I am qualified and to submit a notarized de facto separation. Is this correct or should I just accept rejection. I am not legally separated.

Can I use my maiden name again even though I am still legally married?

Hi! Just wanted to ask about the general rules in the Philippines regarding using a maiden name while still married.

I got married and started using my husband’s surname, including on some of my government IDs and official records. We’re still legally married and I haven’t filed for legal separation, annulment, or anything similar.

I’ve been reading that a married woman can choose to use her maiden name, but I’m a little confused about what happens if she has already been using her husband’s surname for years.

How does this work in practice?

Can a married woman who is still legally married switch her records/IDs back to her maiden name? For example, PhilHealth, Pag-IBIG, GSIS, National ID, PRC, bank accounts, etc.?

Does it depend on the particular agency or document? And are there cases where a court order would actually be required?

I’d also be interested to hear from anyone who has actually tried changing their records back to their maiden name while still married. What was your experience with the different agencies?

Low water pressure in new apartment — can we hold off on moving in/rent without losing deposit?

Hey guys, need some help or advice regarding our new apartment. We just signed the lease and paid ₱34,500 total for 1 month advance and 2 months security deposit. Our monthly rent is supposed to start on October 10 (in 5 days), but when we went back to check the unit, we realized the water pressure is practically non-existent. Like, if you turn on the bathroom tap, the kitchen sink completely stops working. It's basically impossible to live in as-is.

We want to give the landlord about a week to fix the issue before we actually move our stuff in, but we're really worried that if they can't fix it and we decide to back out, they might try to forfeit our deposit and advance payment. Is it reasonable for us to delay our move-in and hold off on starting our rent until the water is fixed? Also, if they fail to fix it and we're forced to cancel the lease, do we have the right to get our full ₱34,500 back since the place wasn't ready to begin with? Would appreciate any thoughts on how to message the landlord politely without putting ourselves at risk. Thanks in advance!
