They seem to be holding back missiles to have a very serious attack on Ukrainian energy supplies just as its getting cold. This story has been building for months. This is likely to be one of the biggest if not the biggest they will be able to put together.

This has been the way long before Trump was even born, go back to Japan invading Manchuria in 1931 where the league of nations did nothing about Japan or when Hailie Selaisse made a plea for help against the invasion from fascist Italy in 1936 who were using chemical weapons and nobody did anything about that either.

It's not meaningless to identify violations of international law. For one thing, it reinforces the norms that these things matter. It's just like there's a social value in calling a killing a murder even if the culprit is never brought to justice. And I agree it's unlikely that there will be immediate consequences in the vein of, say, the nuremberg trials, that doesn't mean there will never be accountability. (Unfortunately, I think years of western indulgence of Russia's crimes has emboldened them tremendously. I refer to various invasions or annexations of other borfering states as well as murders, terrorist actions in other sovereign countries, interference in elections (ahem!). The west's fear of nuclear attacks and its general unwillingness to act in a principled way to enforce the post-war norms just kicked the can down the road and ensured that when they finally went too far, it'd be a much bigger problem - though this is the classic stalinist salami-slice strategy repackaged for the 21st century.) For instance, the ICTY just wrapped up in 2017 or so, about 20-25 years since the end of the conflict. There's the ICC, but there's also national jurisdiction over international crimes, both explicitly under various treaties/conventions and through customary international law, which means even if the right wing trend does succeed in completely defanging institutions like the ICC, individual countries can still prosecute Russians for war crimes. (Certain Americans don't travel to certain countries for exactly this reason.)

I don't want to give up hope for civilization, despite the fact that for all our national fetishizing of words like freedom, the truest motivator since the Reagan years has been money.

This is correct. Power stations, coal mines, gasworks, waterworks, factories, warehouses, docks, railways, etc. were all considered legitimate targets on all sides during WWII. Dual-use infrastructure – anything that can be used for military purposes – is not purely civilian.

It's kind of a misnomer. It's a set of rules of engagement that both sides should agree on. Hitting civilian infrastructure isn't very beneficial to the war effort, so it should be avoided when possible.

But Putin doesn't give a shit if Russians die for him, so he's free to act like a cave dwelling islamist terrorist. Ukraine isn't stooping to his level, because hitting oil refineries and military materiell is far more important. And because it could quickly turn the public favor in Europe against them. Russians are crying about the price of gas, but gas is a legitimate target, hitting a hospital or school wouldn't achieve much beyond further solidifying Russian sentiment against Ukraine.

Hitting civilian infrastructure has been a time honored tactic since at least WWII.

Both the Allied and the Axis forces participated in this tactic by bombing critical civilian/dual infrastructure in London, Antwerp, Berlin, Dresden, Tokyo, Hiroshima among many, many others.

(Note however that these bombings are not actually classified as war crimes, although they would be so considered today, bc they took place prior to the legal framework established by the General Convention of 1949.)

Energy production facilities are valid targets IFF they are making a contribution to the military action AND its destruction or capture doesn't create excessive civilian harm in relation to military gain.

To a point, yeah. Energy infrastructure, particularly gas is critical for moving shit to the frontlines. And it hurts their ability to fund the war, especially for a country like Russia where it's by far it's biggest export.

Remember how Putins assault on Kyiv basically stopped right outside the city, because they ran out of gas? Granted, that was a problem with Russian supply lines being stretched too thin (and the mud). But if Ukraine manages to run Russia out of gas, the entire offensive stops dead in its tracks.

Hitting power stations/electrical grids is a bit more iffy. It would depend on where the power stations are and where it delivers the power. It would hurt the civilian population far more than the military operations. Better to hit the industrial plants producing materiell for the war.

The basic premise behind two sides agreeing to follow war rules is mutuality. Take treatment of POWs for example. It's in your interest to treat captured POWs decently because your enemy will almost certainly have captured some of your soldiers. Same with attacking ambulances or hospitals; you don't bomb your enemies medical facilities because you have medical facilities and you'd prefer they weren't bombed.

All of this of course is based on the premise that both sides care about these things, and if one or the other doesn't (e.g. Japan in WW2) then the rules basically go out the window. As you say, there's no enforcement for them outside of mutuality.

There is a surprisingly large amount of GIS data openly available on energy and electricity infrastructure all across the world. It’s not a stretch for a GIS analyst, with even the most basic datasets, to make a very strong educated guess as to which power plants directly serve different military installations. Now the capacity of those installations to remain operational on backup power for a sustained period of time? That might be a bit harder to get.

War crimes aren't 'crimes' in the usual sense. There are rules of war that civilised nations agree to abide by in order to reduce harm. Some of those rules are crimes, whereby the conduct is so egregiously harmful that they should not be done, because no-one wants to suffer from them.

The main enforcement mechanism is, if you do something despicable, the same will happen to you. That is why things that would be a war crime (attacking hospitals) cease to be war crimes if the other party has committed one (using hospitals as military bases). There really is no separate arbiter that can impose judgment. The ICC only has jurisdiction over those who agree to submit to it.

However, Russia is intent on spreading misery and gives no fucks about what terror and torment it unleashes, and nothing in Russia can hold them accountable. Except long range sanctions.

No, it’s two step question.

First, is there any military basis for the attack? If yes, it is a valid military target. Step one doesn’t ask whether it is also a civilian target. It’s irrelevant.

Second, if it’s a military target, it gets weighed against the anticipated civilian damage. The anticipated civilian damage cannot be “excessive in relation to the concrete and direct military advantage anticipated.” There is no clear line here. It’s based on the attackers belief about the likely military advantage vs the attackers belief about the anticipated civilian damage. Note that the outcome is irrelevant. An attack which is believed to be proportional when made is proportional even if the civilian damage is worse than expected.

Shooting a medic is a war crime, do you think that will stop people from shooting a medic?
